SYNOPSIS AS INTRODUCED:
 
20 ILCS 2310/2310-33 new

    Amends the Department of Public Health Powers and Duties Law. Authorizes the Department of Public Health to establish reasonable billing rates for certain persons and entities requesting electronic access to certain types of patient data collected under the Illinois Health Finance Reform Act. Requires all moneys received by the Department from such billing procedures to be deposited into the Public Health Special State Projects Fund. Provides that the Department shall comply with State and federal laws to protect patient confidentiality. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Public Health Powers and
5 Duties Law of the Civil Administrative Code of Illinois is
6 amended by adding Section 2310-33 as follows:
 
7     (20 ILCS 2310/2310-33 new)
8     Sec. 2310-33. Access to patient billing data. To establish
9 reasonable billing rates for persons requesting electronic
10 access to patient data collected under Section 4-2 of the
11 Illinois Health Finance Reform Act for use by a requesting
12 entity, including, but not limited to, an agency, academic
13 research organization, or private sector organization, and for
14 producing studies, data products, or analyses of such data. All
15 moneys received by the Department from the billing authorized
16 under this Section must be deposited into the Public Health
17 Special State Projects Fund. In providing electronic access to
18 patient billing data, the Department shall undertake all steps
19 necessary under State and federal law, including the
20 Gramm-Leach-Bliley Act (12 U.S.C. §1811 et. seq.) and the
21 Health Insurance Portability and Accountability Act privacy
22 regulations (45 C.F.R. Part 164), to protect patient
23 confidentiality in order to prevent the identification of
24 individual patients.
 
25     Section 99. Effective date. This Act takes effect upon
26 becoming law.
