    Amends the School Code. In a Section regarding reclassification of principals in school districts other than the Chicago school district, provides that upon non-renewal of a principal's administrative contract, the principal shall be reclassified pursuant to the Section.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by changing Section
5 10-23.8b as follows:
 
6     (105 ILCS 5/10-23.8b)  (from Ch. 122, par. 10-23.8b)
7     Sec. 10-23.8b. Reclassification of principals. Upon
8 non-renewal of a principal's administrative contract, the
9 principal shall be reclassified pursuant to this Section. No
10 principal who has completed 2 or more years of administrative
11 service in the school district may be reclassified by demotion
12 or reduction in rank from one position within a school district
13 to another for which a lower salary is paid without written
14 notice from the board of the proposed reclassification by April
15 1 of the year in which the contract expires.
16     Within 10 days of the principal's receipt of this notice,
17 the school board shall provide the principal with a written
18 statement of the facts regarding reclassification, and the
19 principal may request and receive a private hearing with the
20 board to discuss the reasons for the reclassification. If the
21 principal is not satisfied with the results of the private
22 hearing, he may, within 5 days thereafter, request and receive
23 a public hearing on the reclassification. Any principal may be
24 represented by counsel at a private or public hearing conducted
25 under this Section.
26     If the board decides to proceed with the reclassification,
27 it shall give the principal written notice of its decision
28 within 15 days of the private hearing or within 15 days of the
29 public hearing held under this Section whichever is later. The
30 decision of the board thereupon becomes final.
31     Nothing in this Section prohibits a board from ordering
32 lateral transfers of principals to positions of similar rank

2     The changes made by this amendatory Act of the 94th General
3 Assembly are declaratory of existing law.
