AMENDMENT TO SENATE BILL 854

AMENDMENT NO. ______. Amend Senate Bill 854 by replacing everything after the enacting clause with the following:

"Section 5. The School Code is amended by adding Sections 10-20.40 and 34-18.33 as follows:

(105 ILCS 5/10-20.40 new)

Sec. 10-20.40. Wind farm. A school district may own and operate a wind generation turbine farm, either individually or jointly, that directly or indirectly reduces the energy costs of the school district.

(105 ILCS 5/34-18.33 new)

Sec. 34-18.33. Wind farm. The school district may own and operate a wind generation turbine farm, either individually or jointly, that directly or indirectly reduces the energy costs of the school district.

Section 10. The Public Community College Act is amended by adding Section 3-42.3 as follows:

(110 ILCS 805/3-42.3 new)

Sec. 3-42.3. Wind farm. To own and operate a wind generation turbine farm, either individually or jointly, that directly or indirectly reduces the energy costs of the community college district.

Section 99. Effective date. This Act takes effect upon becoming law.".
