SYNOPSIS AS INTRODUCED:
 
75 ILCS 5/5-5   from Ch. 81, par. 5-5
75 ILCS 16/40-45

    Amends the Illinois Local Library Act and the Public Library District Act of 1991. Provides that certain contracts in excess of $20,000 (now, $10,000) must be let by competitive bidding. Effective immediately.

1     AN ACT concerning libraries.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Local Library Act is amended by
5 changing Section 5-5 as follows:
 
6     (75 ILCS 5/5-5)  (from Ch. 81, par. 5-5)
7     Sec. 5-5. When the directors determine to commence the
8 construction of the building or the remodeling, repairing or
9 improving of an existing library building or the erection of an
10 addition thereto, the purchase of the necessary equipment for
11 such library, or the acquisition of library materials such as
12 books, periodicals, recordings and electronic data storage and
13 retrieval facilities in connection with either the purchase or
14 construction of a new library building or the expansion of an
15 existing library building, they may then revise the plan
16 therefor or adopt a new plan and provide estimates of the costs
17 thereof, and shall, when the cost is in excess of $20,000
18 $10,000, advertise for bids for the construction of the
19 building, or the remodeling, repairing or improving of an
20 existing library building or the erection of an addition
21 thereto, or the purchase of the necessary equipment for such
22 library, or the acquisition of library materials such as books,
23 periodicals, recordings and electronic data storage and
24 retrieval facilities in connection with either the purchase or
25 construction of a new library building or the expansion of an
26 existing library building, and shall let the contract or
27 contracts for the same, when the cost is in excess of $20,000
28 $10,000, to the lowest responsible bidder or bidders and may
29 require from such bidders, such security for the performance of
30 the bids as the board shall determine. The directors may let
31 the contract or contracts to one or more bidders, as they shall
32 determine.

2     Section 10. The Public Library District Act of 1991 is
3 amended by changing Section 40-45 as follows:
 
4     (75 ILCS 16/40-45)
5     Sec. 40-45. Bids for construction, improvements, or
6 equipment purchases.
7     (a) When the trustees determine to commence constructing
8 the building, purchasing a site or a building, remodeling,
9 repairing, or improving an existing library building, erecting
10 an addition to an existing library building, or purchasing the
11 necessary equipment for the library, they may then revise the
12 plan or adopt a new plan and provide estimates of the costs of
13 the revised or new plan.
14     (b) The board shall, when the cost is in excess of $20,000
15 $10,000, advertise for bids for constructing the building,
16 remodeling, repairing, or improving of an existing library
17 building, erecting an addition to an existing library building,
18 or purchasing the necessary equipment for the library and shall
19 let the contract or contracts for the project, when the cost is
20 in excess of $20,000 $10,000, to the lowest responsible bidder
21 or bidders. The board shall require from the bidders security
22 for the performance of the bids determined by the board
23 pursuant to law. The trustees may let the contract or contracts
24 to one or more bidders as they determine.

26     Section 99. Effective date. This Act takes effect upon
27 becoming law.
