| AN ACT concerning finance.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Build Illinois Act is amended by changing | 5 |
| Section 8-2 as follows:
| 6 |
| (30 ILCS 750/8-2) (from Ch. 127, par. 2708-2)
| 7 |
| Sec. 8-2. Definitions. As used in this Article:
| 8 |
| (a) "Department" means the Illinois Department of Commerce | 9 |
| and
Economic Opportunity.
| 10 |
| (b) "Local government" means any unit of local government | 11 |
| as defined in
Article VII, Section 1 of the 1970 Illinois | 12 |
| Constitution.
| 13 |
| (c) "Business retention, development or expansion project"
| 14 |
| means the expansion of an existing, for-profit commercial,
| 15 |
| industrial, manufacturing, scientific, agricultural or
service | 16 |
| business within Illinois, or the establishment of a
new such | 17 |
| business on a site within Illinois, so long as the
business to | 18 |
| be established is not relocating from another
site within the | 19 |
| State, unless the relocation of such a business
will result in | 20 |
| a substantial increase in employment or retention of an
| 21 |
| existing such business.
| 22 |
| (d) "Public infrastructure" means local roads and streets, | 23 |
| access roads,
bridges, and sidewalks; waste disposal systems; |

| water and sewer line extensions
and water distribution and | 2 |
| purification facilities, and sewage treatment
facilities; rail | 3 |
| or air or water port improvements; gas and electric utility
| 4 |
| facilities; transit capital facilities; brownfields site | 5 |
| remediation; and development
and improvement of publicly owned | 6 |
| industrial and commercial
sites, or other public capital | 7 |
| improvements which are an
essential precondition to a business | 8 |
| retention, development or expansion
project for the purposes of | 9 |
| the Business Development Public Infrastructure
Loan and Grant | 10 |
| Program. "Public Infrastructure" also means capital
| 11 |
| acquisitions, construction, and improvements to other local | 12 |
| facilities and
sites, and associated permanent furnishings and | 13 |
| equipment that are a necessary
precondition to local health, | 14 |
| safety and economic development for purposes of
the Affordable | 15 |
| Financing of Public Infrastructure Loan and Grant Program.
| 16 |
| (e) "Local public entity" means any entity as defined by | 17 |
| Section 1-206 of
the Local Governmental and Governmental | 18 |
| Employees Tort Immunity Act.
| 19 |
| (f) "Medical facility" and "public health clinic" mean any | 20 |
| entity as defined
by subsections (a) and (c), respectively, of | 21 |
| Section 6-101 of the Local
Governmental and Governmental | 22 |
| Employees Tort Immunity Act.
