SYNOPSIS AS INTRODUCED:

70 ILCS 805/5.3

from Ch. 96 1/2, par. 6308.3

Amends the Downstate Forest Preserve District Act. Provides that any district lands incorporated into a municipality organized after January 1, 2007 shall be deemed to be disconnected from the municipality unless the district gives express consent within 90 days after a court order declaring the municipality to be incorporated.

AN ACT concerning forest preserve districts.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Downstate Forest Preserve District Act is amended by changing Section 5.3 as follows:

(70 ILCS 805/5.3) (from Ch. 96 1/2, par. 6308.3)

Sec. 5.3. Property owned by a forest preserve district shall not be subject to annexation or incorporation without express consent of the forest preserve district. Any district lands incorporated into a municipality organized after January 1, 2007 shall be deemed to be disconnected from the municipality unless the district gives express consent to inclusion of those lands within 90 days after a court order declaring the municipality to be incorporated.
