AMENDMENT TO HOUSE BILL 4803

AMENDMENT NO. ______. Amend House Bill 4803 by replacing everything after the enacting clause with the following:

"Section 5. The Illinois Renewable Fuels Development Program Act is amended by changing Section 15 as follows:

(20 ILCS 689/15)

Sec. 15. Illinois Renewable Fuels Development Program.

(a) The Department must develop and administer the Illinois Renewable Fuels Development Program to assist in the construction, modification, alteration, or retrofitting of renewable fuel plants in Illinois. The recipient of a grant under this Section must:

(1) be constructing, modifying, altering, or retrofitting a plant in the State of Illinois;

(2) be constructing, modifying, altering, or retrofitting a plant that has annual production capacity of no less than 30,000,000 gallons of renewable fuel per year; and

(3) enter into a project labor agreement as prescribed by Section 25 of this Act; .

(4) have received all construction permits required for the project by the Environmental Protection Agency; and

(5) provide a documented water supply, treatment, and discharge plan for the plant's operations, including:

(i) proposed and alternative source water characterization including water quality, quantity, and biota of the sources;

(ii) proposed average daily and maximum annual water needs of the proposed project;

(iii) a demonstration that the proposed water withdrawals will not jeopardize the reliability of existing uses or natural conditions of the same source waters, or other waters that are dependent on flows from the source waters;

(iv) a characterization of the proposed wastewater discharge from the plant, including water quality and quantity with consideration of potential for erosion or habitat destruction in the receiving stream;

(v) a demonstration that the plant will employ Best Available Technology (BAT) for water conservation, including options for potential reuse of the plant's wastewater;

(vi) a characterization of the plant's wastewater treatment and monitoring practices, including both process water and stormwater;

(vii) a characterization of the waters that will receive the wastewater and stormwater discharges from the plant, including their quality, quantity, and existing biota; and

(viii) demonstration of a system for monitoring of total trihalomethanes (TTHMs) and haloacetic acids (HAAs) if the applicant proposes to use chlorine as a biocide in the cooling water.

(b) Grant applications must be made on forms provided by and in accordance with procedures established by the Department.

(c) The Department must give preference to applicants that use Illinois agricultural products in the production of renewable fuel at the plant for which the grant is being requested.
