AMENDMENT TO HOUSE BILL 852

AMENDMENT NO. ______. Amend House Bill 852 by replacing everything after the enacting clause with the following:

"Section 5. The Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois is amended by adding Section 605-725 as follows:

Sec. 605-725. Tourism promotion at highway rest areas.

(a) Subject to appropriation, the Department, in consultation with the Department of Transportation, may establish and administer a test program to place at rest areas along highways computer kiosks that provide information on tourism activities in the State.

(b) The Department may seek and approve paid sponsorships for the computer kiosks and paid advertisements to be placed on the computer kiosks from local businesses to offset costs related to the program and to generate revenues for the program. All computer kiosk sponsorships and advertisements approved by the Department must be for (1) local businesses reasonably accessible from the highway on which the computer kiosk is located or (2) the purpose of promoting a local tourism activity or attraction. All amounts received from sponsorships and advertisements shall be deposited into the Tourism Kiosk Finance Fund.

(c) The Tourism Kiosk Finance Fund is created as a special fund in the State Treasury. The Fund shall be administered by the Department of Commerce and Economic Opportunity, in consultation with the Department of Transportation. There shall be credited to the Fund any moneys specifically designated for deposit into the Fund, including revenues from paid sponsorships and advertisements, State appropriations, set asides from public expenditures on capital projects, federal funds, gifts, grants, and private contributions. Earnings attributable to moneys in the Fund shall be deposited into the Fund. Subject to appropriation, the Fund shall be used solely for the purpose of implementing and maintaining the program created by this Section.

(d) The Department may adopt any rules that it deems appropriate to establish and administer the test program under this Section.

(e) The Department must submit annual reports to the General Assembly, the Governor, and the Secretary of Transportation regarding the test program under this Section.

Section 10. The State Finance Act is amended by adding Section 5.719 as follows:

Sec. 5.719. The Tourism Kiosk Finance Fund.

Section 99. Effective date. This Act takes effect July 1, 2009.".
