AMENDMENT TO HOUSE BILL 5350

2     AMENDMENT NO. ______. Amend House Bill 5350 as follows:
 
3 on page 1, by replacing lines 12 through 23 with the following:
 
4     "(405 ILCS 5/1-119)  (from Ch. 91 1/2, par. 1-119)
5     Sec. 1-119. "Person subject to involuntary admission"
6 means:
7         (1) A person with mental illness and who because of his
8     or her illness is reasonably expected to engage in
9     dangerous conduct which may include threatening behavior
10     or conduct that places that person or another individual in
11     physical harm or in reasonable expectation of being
12     physically harmed, unless treated on an inpatient basis;
13         (2) A person with mental illness and who because of his
14     or her illness is unable to provide for his or her basic
15     physical needs so as to guard himself or herself from
16     serious harm without the assistance of family or outside

1     help, unless treated on an inpatient basis; or
2         (3) A person with mental illness who:
3             (i) refuses treatment or is not adhering
4         adequately to prescribed treatment;
5             (ii) because of the nature of his or her illness,
6         is unable to understand his or her need for treatment;
7         and
8             (iii) if not treated, is reasonably expected,
9         based on his or her behavioral history, to suffer
10         mental or emotional deterioration and, after such
11         deterioration, meets the criteria of either paragraph
12         (1) or paragraph (2) of this Section. , because of the
13         nature of his or her illness, is unable to understand
14         his or her need for treatment and who, if not treated,
15         is reasonably expected to suffer or continue to suffer
16         mental deterioration or emotional deterioration, or
17         both, to the point that the person is reasonably
18         expected to engage in dangerous conduct.
19     In determining whether a person meets the criteria
20 specified in paragraph (1), (2), or (3), the court may consider
21 evidence of the person's repeated past pattern of specific
22 behavior and actions related to the person's illness.
