AMENDMENT TO SENATE BILL 43

2     AMENDMENT NO. ______. Amend Senate Bill 43 on page 1, line
3 5 by inserting "and adding Section 4.1" after "11b"; and
 
4 by replacing lines 18 through 26 of page 2 and lines 1 through
5 16 of page 3 with the following:
6 "Section 35 of the Local Government Facility Lease Act."; and
 
7 on page 13, by inserting after line 5 the following:
 
8     "(820 ILCS 130/4.1 new)
9     Sec. 4.1. Pilot program.
10     (a) A pilot program is established under which the
11 provisions of this Act shall apply to projects in one
12 enterprise zone as defined in the Illinois Enterprise Zone Act,
13 excepting: (i) a project performed by a business enterprise
14 located in an enterprise zone where that business enterprise
15 existed prior to the adoption of an initiating ordinance

1 pursuant to subsection (a) of Section 5 of the Illinois
2 Enterprise Zone Act; or (ii) a project at an owner-occupied
3 single family residence, excepting single-family tract
4 housing, or at an owner-occupied multi-family residence with 6
5 or fewer units located in an enterprise zone or an economic
6 development project area.
7     (b) The Department of Commerce and Economic Opportunity
8 shall select the enterprise zone under subsection (a) and the
9 Department's selection must be approved by joint resolution
10 adopted by the affirmative vote of at least three-fifths of the
11 members elected to each house of the General Assembly.
12     (c) The duration of the pilot program established under
13 this Section shall be 10 years. At the conclusion of the pilot
14 program, the Department of Commerce and Economic Opportunity
15 shall submit a report containing its findings and
16 recommendations regarding the pilot program to the Governor and
17 the General Assembly.".
