SYNOPSIS AS INTRODUCED:
 
40 ILCS 5/1-109.3 new
30 ILCS 805/8.33 new

    Amends the Illinois Pension Code. Requires all elected and appointed trustees of downstate police and fire pension funds to participate in a mandatory trustee certification training seminar that must consist of at least 32 hours of initial trustee certification at a training facility that is accredited and affiliated with a State of Illinois certified college or university. Provides guidelines for the training. Provides that, in addition to the initial trustee certification training, those elected and appointed trustees shall also participate in a minimum of 16 hours of continuing trustee education each year thereafter. Requires the employer to pay for the training. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1     AN ACT concerning public employee benefits.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Pension Code is amended by adding
5 Section 1-109.3 as follows:
 
6     (40 ILCS 5/1-109.3 new)
7     Sec. 1-109.3. Training requirement for pension trustees.
8     (a) All elected and appointed trustees appointed under
9 Article 3 and 4 of this Code must participate in a mandatory
10 trustee certification training seminar that must consist of at
11 least 32 hours of initial trustee certification at a training
12 facility that is accredited and affiliated with a State of
13 Illinois certified college or university. This training must
14 include without limitation all of the following:
15         (1) Duties and liabilities of a fiduciary under Article
16     1 of the Illinois Pension Code.
17         (2) Adjudication of pension claims.
18         (3) Basic accounting and actuarial training.
19         (4) Trustee ethics.
20         (5) The Illinois Open Meetings Act.
21         (6) The Illinois Freedom of Information Act.
22     The elected and appointed trustees of an Article 3 or 4
23 pension fund shall be permitted time off to attend such

1 training without reduction of accrued leave or benefit time.
2 Active or appointed trustees who have attended such certified
3 training before the effective date of this amendatory Act of
4 the 96th General Assembly shall not be required to attend new
5 training.
6     (b) In addition to the initial trustee certification
7 training required under subsection (a), all elected and
8 appointed trustees appointed under Article 3 and 4 of this Code
9 shall also participate in a minimum of 16 hours of continuing
10 trustee education each year thereafter.
11     (c) The training required under this Section shall be paid
12 for by the trustee's employer.
 
13     Section 90. The State Mandates Act is amended by adding
14 Section 8.33 as follows:
 
15     (30 ILCS 805/8.33 new)
16     Sec. 8.33. Exempt mandate. Notwithstanding Sections 6 and 8
17 of this Act, no reimbursement by the State is required for the
18 implementation of any mandate created by this amendatory Act of
19 the 96th General Assembly.
 
20     Section 99. Effective date. This Act takes effect upon
21 becoming law.
