SYNOPSIS AS INTRODUCED:
 
20 ILCS 5/5-715 new

    Amends the Civil Administrative Code of Illinois. Provides that a department or agency of the State shall not implement any part of the federal health care reform authorized by the Patient Protection and Affordable Care Act passed by the United States Congress on March 23, 2010 until all state challenges to the constitutionality of the key provisions of the Act are fully adjudicated. Sets forth a definition for "federal health care reform". Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Civil Administrative Code of Illinois is
5amended by adding Section 5-715 as follows:
 
6    (20 ILCS 5/5-715 new)
7    Sec. 5-715. Implementation of federal health care reform;
8prohibition.
9    (a) A department or agency of the State shall not implement
10any part of the federal health care reform authorized by the
11Patient Protection and Affordable Care Act passed by the United
12States Congress on March 23, 2010 until all state challenges to
13the constitutionality of the key provisions of the Act are
14fully adjudicated.
15    (b) For the purpose of this Section, "federal health care
16reform" means federal legislation or federal regulation that
17does the following:
18        (1) mandates an individual to purchase health
19    insurance;
20        (2) mandates a small employer to provide health
21    insurance coverage for employees;
22        (3) imposes penalties on small employers who do not
23    provide health insurance for their employees;

1        (4) expands eligibility for the Medicaid program or the
2    Children's Health Insurance Program and passes the cost of
3    that expansion to the State;
4        (5) creates new insurance coverage mandates; or
5        (6) creates a new government-run, public insurance
6    program.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.
