AMENDMENT TO HOUSE BILL 2649

2    AMENDMENT NO. ______. Amend House Bill 2649 as follows:
 
3on page 4, line 7, after "witnesses." by inserting "Within 120
4days of the filing of a complaint, the Department shall notify
5the employer in writing of the filing of a complaint and
6provide the employer the location and approximate date of the
7project or projects, affected contractors, and the nature of
8the allegations being investigated."; and
 
9on page 5, by replacing lines 3 through 9 with the following:
10    "(d) The employer has 28 calendar days from the date of the
11Department's findings to answer the allegations contained in
12the Department's findings. If an employer fails to answer all
13allegations contained in the Department's findings, any
14unanswered allegations or findings shall be deemed admitted to
15be true and shall be found true in the final decision issued by
16the Administrative Law Judge. If, within 30 calendar days of

1the final decision issued by the Administrative Law Judge, the
2employer files a motion to vacate the Administrative Law
3Judge's final decision and demonstrates good cause for failing
4to answer the Department's allegations, and the Administrative
5Law Judge grants the motion, the employer shall be afforded an
6opportunity to answer and the matter shall proceed as if an
7original answer to the Department's findings had been filed.";
8and
 
9on page 5, by deleting lines 15 through 19; and
 
10on page 6, line 9, by replacing "$1,500" with "$1,000 $1,500";
11and
 
12on page 6, line 12, by replacing "$2,500" with "$2,000 $2,500";
13and
 
14on page 7, line 16, by changing "an employer" to "a
15corporation"; and
 
16on page 7 by replacing line 19 with the following:
17"assessed under this Act. This Section shall not apply to an
18individual who is an officer or agent of a corporation which on
19the project under investigation satisfies the responsible
20bidder requirements set forth in the Illinois Procurement
21Code.".
