SYNOPSIS AS INTRODUCED:
 
220 ILCS 5/5-117 new
220 ILCS 5/5-115 rep.

    Amends the Public Utilities Act. Provides that the Illinois Commerce Commission shall require all gas, electric, and water companies with at least 100,000 customers under its authority, all local exchange telecommunications carriers with at least 35,000 subscriber access lines, and a person or entity providing cable or video service to submit an annual report by April 15, 2014 and every April 15 thereafter, in a searchable Adobe PDF format, on all procurement goals and actual spending for female-owned, minority-owned, veteran-owned, and small business enterprises in the previous calendar year. Provides that each participating company shall include certain specified information in its annual report. Provides that each annual report shall include as much State-specific data as possible. Provides that the Commission and all participating entities shall hold an annual workshop open to the public in June of 2014 and every year thereafter on the state of supplier diversity to collaboratively seek solutions to structural impediments to achieving stated goals. Repeals a provision concerning minority, female, veterans, small business reports and spending. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Utilities Act is amended by adding
5Section 5-117 as follows:
 
6    (220 ILCS 5/5-117 new)
7    Sec. 5-117. Supplier diversity goals.
8    (a) The public policy of this State is to collaboratively
9work with companies that serve Illinois residents to improve
10their supplier diversity in a non-antagonistic manner.
11    (b) The Commission shall require all gas, electric, and
12water companies with at least 100,000 customers under its
13authority, all local exchange telecommunications carriers with
14at least 35,000 subscriber access lines, and a person or entity
15providing cable or video service, as defined in Section 21-201
16of this Act, to submit an annual report by April 15, 2014 and
17every April 15 thereafter, in a searchable Adobe PDF format, on
18all procurement goals and actual spending for female-owned,
19minority-owned, veteran-owned, and small business enterprises
20in the previous calendar year. These goals shall be expressed
21as a percentage of the total work performed by the entity
22submitting the report, and the actual spending for all
23female-owned, minority-owned, veteran-owned, and small

1business enterprises shall also be expressed as a percentage of
2the total work performed by the entity submitting the report.
3    (c) Each participating company in its annual report shall
4include the following information:
5        (1) an explanation of the plan for the next year to
6    increase participation;
7        (2) an explanation of the plan to increase the goals;
8        (3) the areas of procurement each company shall be
9    actively seeking more participation in in the next year;
10        (4) an outline of the plan to alert and encourage
11    potential vendors in that area to seek business from the
12    company;
13        (5) an explanation of the challenges faced in finding
14    quality vendors and offer any suggestions for what the
15    Commission could do to be helpful to identify those
16    vendors;
17        (6) a list of the certifications the company
18    recognizes;
19        (7) the point of contact for any potential vendor who
20    wishes to do business with the company and explain the
21    process for a vendor to enroll with the company as an
22    minority-owned, women-owned, or veteran-owned company; and
23        (8) any particular success stories to encourage other
24    companies to emulate best practices.
25    (d) Each annual report shall include as much State-specific
26data as possible. If the submitting entity does not submit

1State-specific data, then the company shall include any
2national data it does have and explain why it could not submit
3State-specific data and how it intends to do so in future
4reports, if possible.
5    (e) Each annual report shall include the rules,
6regulations, and definitions used for the procurement goals in
7the company's annual report.
8    (f) The Commission and all participating entities shall
9hold an annual workshop open to the public in June of 2014 and
10every year thereafter on the state of supplier diversity to
11collaboratively seek solutions to structural impediments to
12achieving stated goals, including testimony from each
13participating entity as well as subject matter experts and
14advocates. The Commission shall publish a database on its
15website of the point of contact for each participating entity
16for supplier diversity, along with a list of certifications
17each company recognizes from the information submitted in each
18annual report. The Commission shall publish each annual report
19on its website and shall maintain each annual report for at
20least 5 years.

22    Section 10. The Public Utilities Act is amended by
23repealing Section 5-115.
 
24    Section 99. Effective date. This Act takes effect upon
25becoming law.
