AMENDMENT TO HOUSE BILL 4230

2    AMENDMENT NO. ______. Amend House Bill 4230, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
41, as follows:
 
5on page 1, line 9, by replacing "35" with "35, 45,"; and
 
6on page 25, immediately below line 1, by inserting the
7following:
 
8    "(50 ILCS 751/45)
9    (Section scheduled to be repealed on July 1, 2014)
10    Sec. 45. Continuation of current practices.
11Notwithstanding any other provision of this Act, a unit of
12local government or emergency telephone system board providing
13wireless 9-1-1 service and imposing and collecting a wireless
14carrier surcharge prior to July 1, 1998 may continue its
15practices of imposing and collecting its wireless carrier

1surcharge, but in no event shall that monthly surcharge exceed
2$2.50 per commercial mobile radio service (CMRS) connection or
3in-service telephone number billed on a monthly basis. For
4mobile telecommunications services provided on and after
5August 1, 2002, any surcharge imposed shall be imposed based
6upon the municipality or county that encompasses the customer's
7place of primary use as defined in the Mobile
8Telecommunications Sourcing Conformity Act.
9    In addition to any other lawful purpose, a municipality
10with a population over 500,000 may use the moneys collected
11under this Section for any anti-terrorism or emergency
12preparedness measures, including, but not limited to,
13preparedness planning, providing local matching funds for
14federal or State grants, personnel training, and specialized
15equipment, including surveillance cameras as needed to deal
16with natural and terrorist-inspired emergency situations or
17events.
18    For surcharges collected and remitted pursuant to this
19Section from July 1, 2014 through June 30, 2016, $0.015 per
20surcharge collected shall be deposited into the Poison Response
21Fund for distribution monthly to a human poison control center
22as defined in Section 10 of the Poison Control System Act.
23    For surcharges collected and remitted pursuant to this
24Section from July 1, 2016 through June 30, 2018, $0.0175 per
25surcharge collected shall be deposited into the Poison Response
26Fund for distribution monthly to a human poison control center

1as defined in Section 10 of the Poison Control System Act.
2    For surcharges collected and remitted pursuant to this
3Section on and after July 1, 2018 $0.02 per surcharge collected
4shall be deposited into the Poison Response Fund for
5distribution monthly to a human poison control center as
6defined in Section 10 of the Poison Control System Act.
