AMENDMENT TO HOUSE BILL 4303

2    AMENDMENT NO. ______. Amend House Bill 4303 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Boat Registration and Safety Act is amended
5by adding Section 7-11 as follows:
 
6    (625 ILCS 45/7-11 new)
7    Sec. 7-11. Boating safety videos.
8    (a) The owner of a boat livery, or his or her agent or
9employee, shall not rent a motorboat with over 10 horsepower to
10a person unless the person meets one of the following safety
11requirements:
12        1. possesses a valid boating safety video certificate
13    of completion;
14        2. has completed a boating safety course in this or any
15    other state; or
16        3. has professional knowledge of boating safety due to

1    the nature of his or her employment.
2    (b) The owner, or his or her agent or employee, shall
3record the person's safety requirement compliance category
4under subsection (a) of this Section on the rental contract.
5    (c) If a person renting a motorboat with over 10 horsepower
6is unable to provide satisfactory evidence of compliance with
7the safety requirement under subsection (a) of this Section,
8the owner of the boat livery, or his or her agent or employee,
9shall require the person to view a boating safety video
10approved by the Department. This video shall not be longer than
1120 minutes. Upon completion of the boating safety video, the
12owner of the boat livery, or his or her agent or employee,
13shall provide the person a certificate of completion on a form
14provided by the Department.
15    (d) The Department shall provide access to approved boating
16safety videos to licensed boat liveries.
17    (e) The Department shall adopt rules to implement this
18Section, including but not limited to what constitutes
19satisfactory evidence of the safety requirements of subsection
20(a) of this Section.
21    (f) A violation of this Section is a petty offense.".
