AMENDMENT TO HOUSE BILL 4303

AMENDMENT NO. ______. Amend House Bill 4303 by replacing everything after the enacting clause with the following:

"Section 5. The Boat Registration and Safety Act is amended by adding Section 7-11 as follows:

(625 ILCS 45/7-11 new)

Sec. 7-11. Boating safety videos.

(a) The owner of a boat livery, or his or her agent or employee, shall not rent a motorboat with over 10 horsepower to a person unless the person meets one of the following safety requirements:

1. possesses a valid boating safety video certificate of completion;

2. has completed a boating safety course in this or any other state; or

3. has professional knowledge of boating safety due to the nature of his or her employment.

(b) The owner, or his or her agent or employee, shall record the person's safety requirement compliance category under subsection (a) of this Section on the rental contract.

(c) If a person renting a motorboat with over 10 horsepower is unable to provide satisfactory evidence of compliance with the safety requirement under subsection (a) of this Section, the owner of the boat livery, or his or her agent or employee, shall require the person to view a boating safety video approved by the Department. This video shall not be longer than 20 minutes. Upon completion of the boating safety video, the owner of the boat livery, or his or her agent or employee, shall provide the person a certificate of completion on a form provided by the Department.

(d) The Department shall provide access to approved boating safety videos to licensed boat liveries.

(e) The Department shall adopt rules to implement this Section, including but not limited to what constitutes satisfactory evidence of the safety requirements of subsection (a) of this Section.

(f) A violation of this Section is a petty offense.".
