1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by adding Section
57-67 as follows:
 
6    (10 ILCS 5/7-67 new)
7    Sec. 7-67. Nominations; regional superintendents of
8schools.
9    (a) Notwithstanding any provision of law to the contrary,
10this Section shall apply only to the making of nominations for
11established party candidates for regional superintendent of
12schools in the 2014 general primary election.
13    (b) A candidate's petition for nomination must contain at
14least 200 signatures or the number of signatures equal to 0.5%
15of the primary electors of his or her party in the territory
16comprising the county or counties, whichever is less. For
17purposes of this subsection, the number of primary electors
18shall be determined by taking the total votes cast in the
19applicable district for the candidate for that political party
20who received the highest number of votes, statewide, at the
21last general election in the State at which electors for
22President of the United States were elected.
23    (c) Petitions for nomination for regional superintendent

1of schools shall be filed no earlier than December 16, 2013,
2and no later than December 23, 2013.
3    (d) Petitions for single-county districts shall be filed
4with the county election authority. Petitions for multi-county
5districts shall be filed with the State Board of Elections.
6Signatures and circulator statements on petitions for
7nomination filed with the State Board of Elections or county
8election authority during the filing period for nominations
9shall not be deemed invalid for the sole reason that the
10petitions were circulated between 90 and 111 days before the
11last day for filing petitions.
12    (e) In the case of a conflict between the provisions of
13this Section and any other provision of this Code, the
14provisions of this Section shall control.
 
15    Section 10. The School Code is amended by changing Section
163A-4 as follows:
 
17    (105 ILCS 5/3A-4)  (from Ch. 122, par. 3A-4)
18    Sec. 3A-4. Mandatory consolidation of educational service
19regions.
20    (a) After July 1, 2015, each region must contain at least
2161,000 inhabitants. Before June 30, 2013, regions may be
22consolidated voluntarily under Section 3A-3 or by joint
23resolution of the county boards of regions seeking to join a
24voluntary consolidation, effective July 1, 2015, to meet these

1population requirements. The boundaries of regions already
2meeting these population requirements on the effective date of
3Public Act 97-703 this amendatory Act of the 97th General
4Assembly may not be changed except to consolidate with another
5region or a whole county portion of another region which does
6not meet these population requirements. If, before November 1,
72013 January 1, 2014, locally determined consolidation
8decisions result in more than 35 regions of population greater
9than 61,000 each, the State Board of Education shall, before
10November 23, 2013 June 1, 2014, direct further consolidation,
11beginning with the region of lowest population, until the
12number of 35 regions is achieved.
13    (b) (Blank).
14    (c) If, within 90 days after the most recent certified
15federal census, a region does not meet the population
16requirements of this Section, then regions may be consolidated
17voluntarily under Section 3A-3 of this Code or by joint
18resolution of the county boards of regions seeking to join a
19voluntary consolidation to meet these population requirements.
20If locally determined consolidation decisions result in a
21region not meeting the population requirements of this Section
22or result in more than 35 regions, then the State Board of
23Education shall have the authority to impose further
24consolidation by order of the State Superintendent of
25Education. Such an order shall be a final order and is subject
26to the Administrative Review Law.

1    (d) All population determinations shall be based on the
2most recent federal census.

4    Section 99. Effective date. This Act takes effect upon
5becoming law.
