SYNOPSIS AS INTRODUCED:
 
225 ILCS 85/16c new

    Amends the Pharmacy Practice Act. Provides that beginning January 1, 2016, the Department of Financial and Professional Regulation shall implement a pilot project requiring that every new or refilled prescription for a Schedule II controlled substance containing hydrocodone shall only be dispensed in a non-reusable medicine locking closure package. Defines "medicine locking closure package" and "Schedule II controlled substance". Provides that the medicine locking closure package must be dispensed by the pharmacy with instructions for patient use. Provides that the manufacturer of the medicine locking closure package must make available assistance online or through a toll-free number for patient use. Provides that prescriptions reimbursed via Medicare Part D and Medicaid and prescriptions for individuals residing in facilities licensed under the Nursing Home Care Act are exempt from the requirements of the pilot project. Repeals the provisions creating the pilot project on January 1, 2017. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Pharmacy Practice Act is amended by adding
5Section 16c as follows:
 
6    (225 ILCS 85/16c new)
7    Sec. 16c. Medicine locking closure package.
8    (a) As used in this Section:
9    "Medicine locking closure package" means any alphanumeric
10combination locking closure mechanism that can only be unlocked
11with a user-generated, resettable alphanumeric code in
12combination with an amber prescription container that forms a
13package that allows only the person with a prescription access
14to the medicine.
15    "Schedule II controlled substance" means a Schedule II
16controlled substance under the United States Controlled
17Substances Act and 21 CFR 1308.
18    (b) Effective January 1, 2016, the Department shall
19implement a pilot project requiring that every new or refilled
20prescription for a Schedule II controlled substance containing
21hydrocodone shall only be dispensed in a non-reusable medicine
22locking closure package.
23    (c) The medicine locking closure package must be dispensed

1by the pharmacy with instructions for patient use.
2    (d) The manufacturer of the medicine locking closure
3package must make available assistance online or through a
4toll-free number for patient use.
5    (e) Prescriptions reimbursed via the Medicare Part D and
6Medicaid programs, including Medicaid managed care plans, are
7exempt from the provisions of this Section.
8    (f) Prescriptions for individuals residing in facilities
9licensed under the Nursing Home Care Act are exempt from the
10provisions of this Section.
11    (g) This Section is repealed on January 1, 2017.
 
12    Section 99. Effective date. This Act takes effect upon
13becoming law.
