SYNOPSIS AS INTRODUCED:
 
750 ILCS 50/18.4  from Ch. 40, par. 1522.4

    Amends the Adoption Act. To a list of disclosures required to be made to the adoptive parents, adds facts and circumstances relating to the nature and cause of the adoption, information regarding how adoptive parents were identified, and whether a request or efforts were made regarding continued contact or an open adoption.

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Adoption Act is amended by changing Section
518.4 as follows:
 
6    (750 ILCS 50/18.4)  (from Ch. 40, par. 1522.4)
7    Sec. 18.4. (a) The agency, Department of Children and
8Family Services, Court Supportive Services, Juvenile Division
9of the Circuit Court, or the Probation Officers of the Circuit
10Court involved in the adoption proceedings shall give in
11writing the following non-identifying information, if known,
12to the adoptive parents not later than the date of placement
13with the petitioning adoptive parents: (i) age of biological
14parents; (ii) their race, religion and ethnic background; (iii)
15general physical appearance of biological parents; (iv) their
16education, occupation, hobbies, interests and talents; (v)
17existence of any other children born to the biological parents;
18(vi) information about biological grandparents; reason for
19emigrating into the United States, if applicable, and country
20of origin; (vii) relationship between biological parents;
21(viii) detailed medical and mental health histories of the
22child, the biological parents, and their immediate relatives;
23and (ix) the actual date and place of birth of the adopted

1person; and (x) facts and circumstances relating to the nature
2and cause of the adoption, information regarding how adoptive
3parents were identified, and whether a request or efforts were
4made regarding continued contact or an open adoption. However,
5no information provided under this subsection shall disclose
6the name or last known address of the biological parents,
7grandparents, the siblings of the biological parents, the
8adopted person, or any other relative of the adopted person.
9    (b) Any adoptee 18 years of age or over shall be given the
10information in subsection (a) upon request.
11    (c) The Illinois Adoption Registry shall release any
12non-identifying information listed in (a) of this Section that
13appears on the certified copy of the original birth certificate
14or the Certificate of Adoption to an adopted person, adoptive
15parent, or legal guardian who is a registrant of the Illinois
16Adoption Registry.
17    (d) The Illinois Adoption Registry shall release the actual
18date and place of birth of an adopted person who is 21 years of
19age or over to the birth parent if the birth parent is a
20registrant of the Illinois Adoption Registry and has completed
21a Medical Information Exchange Authorization.
22    (e) The Illinois Adoption Registry shall release
23information regarding the date the adoption was finalized and
24the county in which the adoption was finalized to a certified
25confidential intermediary upon submission of a court order.
26    (f) In cases where the Illinois Adoption Registry possesses

1information indicating that an adopted person who is 21 years
2of age or over was adopted in a state other than Illinois or a
3country other than the United States, the Illinois Adoption
4Registry shall release the name of the state or country where
5the adoption was finalized and, if available, the agency
6involved in the adoption to a registrant of the Illinois
7Adoption Registry, provided the registrant is not the subject
8of a Denial of Information Exchange and the registrant has
9completed a Medical Information Exchange Authorization.
10    (g) Any of the above available information for any adoption
11proceedings completed before the effective date of this Act
12shall be supplied to the adoptive parents or an adoptee 18
13years of age or over upon request.
14    (h) The agency, Department of Children and Family Services,
15Court Supportive Services, Juvenile Division of the Circuit
16Court, the Probation Officers of the Circuit Court and any
17other governmental bodies having any of the above information
18shall retain the file until the adoptee would have reached the
19age of 99 years.
