1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Life Care Facilities Act is amended by
5adding Section 13 as follows:
 
6    (210 ILCS 40/13 new)
7    Sec. 13. Continuing Care Retirement Community Transparency
8Task Force.
9    (a) There is created a Continuing Care Retirement Community
10Transparency Task Force consisting of the following members:
11        (1) The Director of Aging, or the Director's designee.
12        (2) The Director of Public Health, or the Director's
13    designee.
14        (3) One member of the House of Representatives
15    appointed by the Speaker of the House of Representatives.
16        (4) One member of the House of Representatives
17    appointed by the Minority Leader of the House of
18    Representatives.
19        (5) One member of the Senate appointed by the President
20    of the Senate.
21        (6) One member of the Senate appointed by the Minority
22    Leader of the Senate.
23        (7) The following members appointed by the Director of

1    Public Health:
2            (A) 2 representatives selected from
3        recommendations of a statewide organization
4        representing retired people;
5            (B) 2 representatives selected from
6        recommendations of a statewide organization
7        representing Alzheimer's research;
8            (C) 2 representatives selected from
9        recommendations of a statewide organization
10        representing Illinois nursing home communities;
11            (D) one representative selected from
12        recommendations of a senior living facility housing 50
13        residents or more;
14            (E) one representative selected from
15        recommendations of a senior living facility housing
16        fewer than 50 residents; and
17            (F) at least 2 providers who hold permits to enter
18        into life care contracts under this Act, one of whom
19        shall be a representative of a nonprofit organization
20        exempt from federal income taxes.
21    (b) The Task Force is created to research and collect
22information on transparency and consumer protection issues
23related to life care contracts. The Task Force shall review
24existing legal frameworks to identify all existing consumer
25protections for residents living in continuing care retirement
26communities and all areas in which more consumer protections

1for continuing care retirement community residents are
2necessary. The Task Force shall identify any shortcomings of
3the definition of "life care contract" in Section 2 and
4determine whether that definition should be expanded to include
5more senior living facilities.
6    (c) The members appointed to the Task Force pursuant to
7subsection (a) shall be appointed no later than 30 days after
8the effective date of this amendatory Act of the 101st General
9Assembly.
10    (d) The first meeting of the Task Force shall be no later
11than 30 days after all members of the Task Force have been
12appointed. The members of the Task Force shall receive no
13compensation for their services but may be reimbursed for
14expenses from appropriations made for that purpose.
15    (e) The Department of Public Health shall provide
16administrative and other support to the Task Force.
17    (f) The Task Force shall report its findings to the
18Governor and General Assembly by December 31, 2020.
19    (G) This Section is repealed on January 1, 2021.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
