AMENDMENT TO HOUSE BILL 1161

AMENDMENT NO. ______. Amend House Bill 1161 by replacing everything after the enacting clause with the following:

"Section 5. The School Code is amended by adding Section 22-92 as follows:

(105 ILCS 5/22-92 new)

Sec. 22-92. COVID-19 screening and testing reimbursement.

(a) In response to the need to prevent, prepare for, and respond to the novel coronavirus disease deemed COVID-19 by the World Health Organization, each school or school district shall be reimbursed by the federal Elementary and Secondary Emergency Education Relief Fund and the ARP Elementary and Secondary School Emergency Relief Fund established under the federal American Rescue Plan Act of 2021 for costs associated with coronavirus surveillance screening and testing.

(b) Coronavirus screening and testing does not require emergency use authorization from the United States Food and Drug Administration in order for schools and school districts to seek reimbursement for costs associated with coronavirus surveillance screening and testing from the Elementary and Secondary Emergency Education Relief Fund and the ARP Elementary and Secondary Emergency Education Relief Fund established under the federal American Rescue Plan Act of 2021.

Section 99. Effective date. This Act takes effect upon becoming law.".
