AMENDMENT TO HOUSE BILL 1355

2    AMENDMENT NO. ______. Amend House Bill 1355 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Park and Recreational Facility
5Construction Act of 2009 is amended by adding Section 10-50 as
6follows:
 
7    (30 ILCS 764/10-50 new)
8    Sec. 10-50. Change of use. A local government consisting
9of a municipality with a population in excess of 100,000 may
10change a park or recreation use for a park or recreation unit
11construction project for which a grant has been received
12pursuant to this Act to a social service use if the Governor
13has declared a public health emergency for territory including
14such a municipality within the previous 12 months. Such a
15social service use may be operated by such a municipality or by
16a social service agency pursuant to a service agreement or

1pursuant to a sale or lease of such property by the
2municipality to a social service agency. There shall be no
3time limit on such a change in use. Such a change in use shall
4not constitute or be construed as a conversion of the use of
5such recreation unit construction project, and shall not
6constitute or be construed as a violation or breach of any
7applicable grant or grant agreement terms, nor shall such
8change in use require a replacement property, reimbursement of
9any grant funds, or result in any other sanction or penalty.
10The provisions of this Section shall apply to any existing
11park or recreation unit construction projects and grant
12agreements and any park or recreation unit construction
13projects and grant agreements entered into after the effective
14date of this amendatory Act of the 102nd General Assembly.".
