Amends the Military Veterans Assistance Act. Provides that the county board of a county having a population of more
than 3,000,000 may, but is not required to, enter into an
intergovernmental agreement with and provide funding to the
Veterans Assistance Commission of the county.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Military Veterans Assistance Act is amended | 5 | | by changing Section 10 as follows:
| 6 | | (330 ILCS 45/10) (from Ch. 23, par. 3090)
| 7 | | Sec. 10.
| 8 | | (a) The executive powers of the commission shall be vested | 9 | | in a
superintendent elected by the commission from among those | 10 | | who served in
the armed forces of the United States. The | 11 | | superintendent,
designated Superintendent of Veterans | 12 | | Assistance of the county, shall,
under the direction of the | 13 | | commission, have charge of and maintain an
office in the | 14 | | county building or other central location, to be used solely
| 15 | | by the commission for carrying on its assistance work. The | 16 | | county shall
provide the office and furnish all necessary | 17 | | supplies, including telephone,
printing, stationery and | 18 | | postage therefor.
| 19 | | Except as otherwise provided in this subsection (a), the | 20 | | The county board shall, in any county where a Veterans | 21 | | Assistance
Commission is organized, in addition to sums | 22 | | appropriated for assistance and
emergency assistance purposes | 23 | | under this Act, appropriate such additional
sums, upon |

| 1 | | recommendation of the Veterans Assistance Commission and as
| 2 | | approved by the county board, to properly compensate the | 3 | | officers and
employees required to administer such assistance. | 4 | | Such county board
approval shall be based upon recognized and | 5 | | established salary guidelines
developed by the county and used | 6 | | by the county to compensate county
employees. If the county | 7 | | does not have established employee salary
guidelines, the | 8 | | county board shall provide funds to the commission to
| 9 | | compensate the superintendent and his employees in a just | 10 | | manner. The
county board shall also provide funds to the | 11 | | commission to reimburse the
superintendent, officers, | 12 | | delegates and employees for certain expenses
which are | 13 | | approved by the commission. The superintendent and other
| 14 | | employees shall be employees of the Veterans Assistance | 15 | | Commission, and no
provision in this Section or elsewhere in | 16 | | this Act shall be construed to
mean that they are employees of | 17 | | the county.
| 18 | | The county board of a county having a population of more
| 19 | | than 3,000,000 may, but is not required to, enter into an
| 20 | | intergovernmental agreement with and provide funding to the
| 21 | | Veterans Assistance Commission of the county under this
| 22 | | subsection (a). | 23 | | (b) Superintendents, subject to rules formulated by the | 24 | | commission, shall select,
as far as possible, secretaries and | 25 | | other employees from among honorably
discharged military | 26 | | veterans as defined in Section 2, or their surviving
spouses.

| 1 | | Superintendents of all counties subject to this Act, when | 2 | | required by the
commission, shall give bond in the sum of | 3 | | $2,000 for the faithful performance
of their duties.
| 4 | | All persons elected or selected to fill positions provided | 5 | | for in this
Section shall be exempt from the operation and | 6 | | provisions of any civil service
act or laws of this State, and | 7 | | the secretary of the commission shall be
appointed by the | 8 | | superintendent. However, if "The Illinois Public Aid Code",
as | 9 | | amended, becomes applicable in any county, the Department of
| 10 | | Human Services may exercise the powers therein designated in | 11 | | relation to
employees
engaged in the administration of | 12 | | assistance under this Act.
