Amends the Illinois Vehicle Code. Requires that the sale of a motor vehicle that bears equipment, markings, or other indicia of police authority include the removal of all spot lamps from the vehicle prior to delivery of that vehicle.

| 1 | | AN ACT concerning transportation.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by | 5 | | changing Sections 12-207 and 12-609 as follows:
| 6 | | (625 ILCS 5/12-207) (from Ch. 95 1/2, par. 12-207)
| 7 | | Sec. 12-207. Spot lamps and auxiliary driving lamps.
| 8 | | (a) Except as provided in Section 12-609, any Any motor | 9 | | vehicle may be equipped with not to exceed one spot lamp
and | 10 | | every lighted spot lamp shall be so aimed and used upon | 11 | | approaching
another vehicle that no part of the high-intensity | 12 | | portion of the beam will
be directed to the left of the | 13 | | prolongation of the extreme left side of the
vehicle nor more | 14 | | than 100 feet ahead of the vehicle.
| 15 | | (b) Any motor vehicle may be equipped with not to exceed | 16 | | three auxiliary
driving lamps mounted on the front at a height | 17 | | not less than 12 inches nor
more than 42 inches above the level | 18 | | surface upon which the vehicle stands.
| 19 | | (c) The restrictions of subsections 12-207 (a) and 12-207 | 20 | | (b) of this
Act shall not apply to authorized emergency | 21 | | vehicles or equipment used
for snow and ice removal operations | 22 | | if owned or operated by or for any
governmental body.

subsection (b) of Section 12-207 shall not apply to | 2 | | privately owned motor vehicles on
which a snow plow is | 3 | | mounted, while in transit between or during snow and
ice | 4 | | removal operations. This exemption shall apply only during the | 5 | | period
from November 15 through April 1, and only when the snow | 6 | | plow blade, commonly
referred to as a "moldboard", is properly | 7 | | and securely affixed to the front
of the motor vehicle.

(a) No official or employee of the State, any
| 11 | | political subdivision thereof,
any county, municipality, or | 12 | | local authority,
and no
owner or employee of any new vehicle | 13 | | dealer, used vehicle dealer, or vehicle
auctioneer shall
sell, | 14 | | trade or otherwise dispose of any motor
vehicle bearing | 15 | | equipment, markings, or other indicia of police
authority | 16 | | unless, prior to delivery of the vehicle, the equipment and
| 17 | | markings have been sufficiently altered or obliterated to | 18 | | remove the
appearance of such authority. A motor vehicle | 19 | | subject to this subsection shall have all spot lamps removed | 20 | | from the vehicle prior to delivery of the vehicle.
| 21 | | (b) A person may not operate on the highways of this State | 22 | | a vehicle
bearing the equipment, markings, or other indicia of | 23 | | police authority, unless
the vehicle is an authorized | 24 | | emergency vehicle as defined in Section 1-105 of
this Code.
| 25 | | (c) This Section does not apply to vehicles bearing |

| 1 | | indicia of police
authority that are antique vehicles, as | 2 | | defined in Section 1-102.1, and are
registered as antique | 3 | | vehicles, as provided in Section 3-804.
| 4 | | (c-5) Nothing in this Section shall prohibit a | 5 | | manufacturer of authorized emergency vehicle equipment, | 6 | | markings, or other indicia, or the manufacturer's | 7 | | representative or authorized vendor, from temporarily mounting
| 8 | | the equipment, markings, or other indicia on a vehicle for | 9 | | demonstration purposes only. If the equipment, markings, or | 10 | | other indicia are not covered while the vehicle is operated | 11 | | upon a highway, the vehicle shall display signage indicating | 12 | | that the vehicle is out of service or not an emergency vehicle. | 13 | | The signage shall be displayed on all sides of the vehicle in | 14 | | letters at least 2 inches tall and one-half inch wide. | 15 | | (d) Any police officer is authorized to seize any vehicle | 16 | | that is in
violation of this Section and to impound that | 17 | | vehicle, at the owner's expense,
until any equipment, | 18 | | markings, or other indicia of police authority have been
| 19 | | sufficiently removed, altered, or obliterated to remove the | 20 | | appearance of
police
authority.
| 21 | | (e) A person convicted of violating this Section is guilty | 22 | | of a petty
offense and subject to a fine of not less than $500 | 23 | | and not more than $1,000.
