| 2 | | AMENDMENT NO. ______. Amend House Bill 4580 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The School Code is amended by adding Section | 5 | | 34-222 as follows: | 6 | | (105 ILCS 5/34-222 new) | 7 | | Sec. 34-222. School attendance boundaries. | 8 | | (a) At least once every 5 years, the Department of School | 9 | | Demographics and Planning ("DSP") shall evaluate the | 10 | | enrollment at existing schools in the school district to | 11 | | determine if there is a need to revise existing boundaries. | 12 | | (1) In reviewing the enrollment at existing schools to | 13 | | determine if there is a need to revise existing | 14 | | boundaries, DSP shall consider a range of factors, | 15 | | including the following: | 16 | | (A) capacities of the school being reviewed and |

| 1 | | schools with contiguous boundaries to the school being | 2 | | reviewed; | 3 | | (B) current and projected racial and ethnic | 4 | | composition of the school being reviewed and any | 5 | | schools with contiguous boundaries to the school being | 6 | | reviewed; | 7 | | (C) current and projected income level composition | 8 | | of the school being reviewed and any schools with | 9 | | contiguous boundaries to the school being reviewed; | 10 | | (D) geographic barriers; | 11 | | (E) travel time and distance to the school; and | 12 | | (F) program considerations of the school being | 13 | | reviewed and any schools with contiguous boundaries to | 14 | | the school being reviewed. | 15 | | (2) DSP shall submit a written report of its findings, | 16 | | conclusions, and recommendations to the chief executive | 17 | | officer and the Board. The report shall document the | 18 | | evaluation of the factors of the school being reviewed. | 19 | | The report shall be made public on the district's website | 20 | | within 30 days after its completion. | 21 | | (b) If it is determined that there is a need to revise any | 22 | | existing boundaries, DSP shall develop and recommend any | 23 | | proposed changes to the chief executive officer prior to the | 24 | | beginning of the school year in which the changes are to take | 25 | | effect. In addition, DSP shall develop and recommend proposed | 26 | | boundaries for new schools to the chief executive officer |

| 1 | | prior to the beginning of the school year in which the new | 2 | | school boundaries are to take effect. | 3 | | (1) In developing proposed changes to boundaries for | 4 | | existing schools and proposing attendance boundaries for | 5 | | new schools, DSP shall consider a range of factors, | 6 | | including the following: | 7 | | (A) DSP shall consider the capacities of each of | 8 | | the schools involved in the proposed boundary | 9 | | revisions, including the extent
to which a school is | 10 | | overcrowded or underutilized. Where feasible, the goal | 11 | | is for elementary schools to
be utilized at not more | 12 | | than 80% of design capacity and for high schools at not | 13 | | more than 100% of program capacity. Schools shall be | 14 | | considered severely overcrowded if they are
operating | 15 | | in excess of 100% utilization and significantly | 16 | | underutilized if they are operating at less than 30% | 17 | | utilization. DSP shall consider these utilization | 18 | | rates when proposing revisions to attendance | 19 | | boundaries for
existing schools and when proposing | 20 | | attendance boundaries for new schools. | 21 | | (B) DSP shall consider the current and projected | 22 | | racial and ethnic composition of the schools affected. | 23 | | Where feasible, DSP shall propose establishing or | 24 | | revising attendance boundaries to maintain or promote
| 25 | | stably desegregated enrollments in each of the | 26 | | affected schools and to avoid the creation of one-race

| 1 | | schools. | 2 | | (C) DSP shall consider geographic barriers so as | 3 | | to promote safety and minimize transportation burdens, | 4 | | to the extent feasible. | 5 | | (D) DSP shall consider travel time and distance | 6 | | and, to the extent feasible, seek to minimize travel | 7 | | time and distance. | 8 | | (E) DSP shall consider the placement of programs | 9 | | in each of the schools
involved, such as programs for | 10 | | English learners and for special education students. | 11 | | In addition, DSP shall consider the impact of magnet | 12 | | schools and programs and the requirements of the | 13 | | federal Every Student Succeeds Act and the Illinois | 14 | | Balanced Accountability Measures. | 15 | | (2) For each proposed attendance boundary, DSP shall | 16 | | develop at least 2 alternatives. For each alternative, DSP | 17 | | shall prepare a report showing 3-year enrollment | 18 | | projections by racial and ethnic groups for all schools | 19 | | affected by the proposed change pursuant to each | 20 | | alternative. The report shall document for each | 21 | | alternative the impact on the affected schools for the | 22 | | factors of capacity, geographic barriers, travel time and | 23 | | distance, and program considerations. In developing | 24 | | alternatives, DSP shall consider whether any feasible | 25 | | alternatives would better maintain or promote stably | 26 | | desegregated enrollments in each of the affected schools |

| 1 | | or better avoid the creation of one-race schools. The | 2 | | report shall be made public on the district's website | 3 | | within 30 days after its completion. | 4 | | (c) The chief executive officer shall review the report | 5 | | from DSP and may suggest additional alternatives. The chief | 6 | | executive officer shall report to the Board if he or she | 7 | | recommends any changes to existing boundaries or establishing | 8 | | boundaries for new schools. If the chief executive officer is | 9 | | recommending any changes to existing boundaries or | 10 | | establishing any boundaries for new schools, the chief | 11 | | executive officer shall provide the Board with a report of the | 12 | | alternatives considered, including data on the factors of | 13 | | capacity, current and projected racial and ethnic | 14 | | considerations, geographic barriers, travel time and distance, | 15 | | and program considerations. The chief executive officer shall | 16 | | inform the Board of the alternative that is being recommended. | 17 | | The report shall be made public on the district's website | 18 | | within 30 days after its completion. | 19 | | (d) Prior to taking action on the establishment or | 20 | | revision of any attendance boundaries, the Board shall conduct | 21 | | public hearings on the proposed establishment or revision of | 22 | | attendance boundaries and the chief executive officer's | 23 | | recommendation. Prior to the public hearing, the Board shall | 24 | | make available reports and data on the factors of capacity, | 25 | | current and projected racial and ethnic considerations, | 26 | | geographic barriers, travel time and distance, and program |

| 1 | | considerations. In making its decision, the Board shall | 2 | | consider the factors of capacity, current and projected racial | 3 | | and ethnic considerations,
geographic barriers, travel time | 4 | | and distance, and program considerations. ".
