| 2 | | WHEREAS, Carbon dioxide is a greenhouse gas, and its | 3 | | emission into the atmosphere is believed to be the primary | 4 | | driver of global warming; one method to mitigate the effects | 5 | | of carbon dioxide emissions is to divert the carbon emissions | 6 | | from the atmosphere into geologic storage/sequestration; and | 7 | | WHEREAS, Geologic carbon dioxide sequestration is a | 8 | | process by which liquefied carbon dioxide is injected into | 9 | | subsurface rock strata; and | 10 | | WHEREAS, Illinois is a prime location for geologic | 11 | | sequestration to occur; beneath the majority of our state are | 12 | | formations known as the Mount Simon sandstone and Eau Claire | 13 | | shale; the sandstone formation is where the carbon is | 14 | | injected, and the Eau Claire shale rests on top of the | 15 | | sandstone locking in the carbon dioxide; and | 16 | | WHEREAS, To encourage sequestration projects, the federal | 17 | | government has begun providing tax credits to entities that | 18 | | operate sequestration projects; therefore, be it | 19 | | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE | 20 | | HUNDRED SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE | 21 | | SENATE CONCURRING HEREIN, that there is created the Carbon |

| 1 | | Capture, Utilization, and Storage Legislation Task Force; and | 2 | | be it further | 3 | | RESOLVED, That the Task Force shall consist of the | 4 | | following members who shall serve without compensation: | 5 | | (1) The Director of the Department of Natural | 6 | | Resources or his or her designee, who shall serve as the chair; | 7 | | (2) One member appointed by the Speaker of the House | 8 | | of Representatives; | 9 | | (3) One member appointed by the President of the | 10 | | Senate; | 11 | | (4) One member appointed by the Minority Leader of the | 12 | | House of Representatives; | 13 | | (5) One member appointed by the Minority Leader of the | 14 | | Senate; | 15 | | (6) The Director of the Illinois Environmental | 16 | | Protection Agency or his or her designee; | 17 | | (7) Two members appointed by the Executive Director of | 18 | | the Prairie Research Institute of the University of Illinois | 19 | | at Urbana-Champaign; and | 20 | | (8) The following members appointed by the Governor: | 21 | | (a) One member with legal expertise; | 22 | | (b) One member with financial expertise; | 23 | | (c) One member representing the State's largest | 24 | | general farm organization; | 25 | | (d) One member representing a statewide |

| 1 | | environmental organization; | 2 | | (e) One member representing a national | 3 | | environmental organization; | 4 | | (f) One member representing the corn industry; | 5 | | (g) One member representing the natural gas | 6 | | industry; | 7 | | (h) One member representing a business that is | 8 | | considering a carbon capture, utilization, and storage | 9 | | project; | 10 | | (i) One member representing a business that is | 11 | | currently performing a carbon capture, utilization, | 12 | | and storage project; | 13 | | (j) One member representing an energy business | 14 | | that has global experience and investments in carbon | 15 | | capture, utilization, and storage technologies; and | 16 | | (k) One member representing a statewide labor | 17 | | federation that represents more than one international | 18 | | union recognized under the National Labor Relations | 19 | | Act; and be it further | 20 | | RESOLVED, That the Department of Natural Resources shall | 21 | | provide administrative support for the Task Force; and be it | 22 | | further | 23 | | RESOLVED, That the Task Force shall hold its first meeting | 24 | | at the call of the chair and at least once a month after that; |

| 1 | | and be it further | 2 | | RESOLVED, That the Task Force is charged with studying the | 3 | | following:
| 4 | | (1) Carbon capture, utilization, and storage in the | 5 | | State in a way that both protects the environment and | 6 | | supports short-term and long-term economic growth; | 7 | | (2) The ownership of carbon dioxide in a carbon | 8 | | capture, utilization, and storage project; | 9 | | (3) The liability for the storage and monitoring | 10 | | maintenance of the carbon dioxide after the completion of | 11 | | a carbon capture, utilization, and storage project; | 12 | | (4) The acquisition, ownership, and amalgamation of | 13 | | pore space; | 14 | | (5) Procedures and safeguards for the capture, | 15 | | utilization, and storage of carbon dioxide; | 16 | | (6) The methodology to establish any necessary fees, | 17 | | costs, or offsets; | 18 | | (7) The potential uses of carbon dioxide; | 19 | | (8) The coordination with applicable federal law or | 20 | | regulatory commissions, including the Class VI injection | 21 | | well permitting process; | 22 | | (9) The creation of rules to develop carbon dioxide | 23 | | pipelines and their related issues; | 24 | | (10) The development of knowledge capacity of | 25 | | appropriate State agencies and stakeholders; and |

| 1 | | (11) The leveraging of public-private partnerships for | 2 | | research, design, and development to benefit the State; | 3 | | and be it further | 4 | | RESOLVED, That the Task Force shall submit it final report | 5 | | no later than December 31, 2022 and is dissolved upon the | 6 | | filing.
