Amends the Uniform Commercial Driver's License Act of the Illinois Vehicle Code. Provides that the employer of an employee driver who drives a commercial motor vehicle may participate in the Employer Notification System. Provides that a request to participate in the employer notification system shall be accompanied by a fee. Provides that any fire department, police department, or other department or agency organized for the purposes of public safety and having official recognition of the city, county, city and county, district, or township in which the department or agency is located shall participate in the employer notification system but shall not be subject to the participation fee. Provides that the Secretary of State's Office shall adopt rules implementing the employer notification system.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by adding | 5 | | Section 6-506.5 as follows: | 6 | | (625 ILCS 5/6-506.5 new) | 7 | | Sec. 6-506.5. Employer notification system. | 8 | | (a) The employer of an employee driver who drives a | 9 | | commercial motor vehicle, as defined in Section 6-500, may | 10 | | participate in the employer notification system,
which is a | 11 | | process for the purpose of providing the employer with a | 12 | | report showing the driver's current public record as recorded | 13 | | by the Secretary of State's Office, and any subsequent | 14 | | convictions, failures to appear, accidents, driver's license | 15 | | suspensions, driver's license revocations, or any other | 16 | | actions taken against the driving privileges or certificate of | 17 | | the driver added to the driver's record while the employer's | 18 | | notification request remains valid and uncanceled. Such | 19 | | records shall be produced automatically upon an employee | 20 | | driver's conviction, failure to appear, accident, driver's | 21 | | license suspension, driver's license revocation, or any other | 22 | | action taken against the driver's driving privileges. | 23 | | (b) Upon the termination of a driver's employment, the |

| 1 | | employer shall notify the Secretary of State's Office to | 2 | | discontinue the driver's enrollment in the employer | 3 | | notification system. | 4 | | (c) A request to participate in the employer notification | 5 | | system established by this Section shall be accompanied by a | 6 | | fee determined by the Secretary of State's Office to be | 7 | | sufficient to defray the entire actual cost to the Secretary | 8 | | in administering the employer notification service. | 9 | | (d) Any fire department, police department, or other | 10 | | department or agency organized for the purposes of public | 11 | | safety and having the official recognition of the city, | 12 | | county, city and county, district, township, or the like in | 13 | | which the department or agency is located shall participate in | 14 | | the employer notification system but shall not be subject to | 15 | | the fee established pursuant to this Section. | 16 | | (e) The Secretary of State's Office shall adopt rules | 17 | | implementing the employer notification system, ensuring driver | 18 | | privacy is safeguarded in compliance with the Privacy Act of | 19 | | 1978, the Driver's Privacy Protection Act of 1994, and any | 20 | | other applicable federal or State law. To the extent | 21 | | practicable, the Secretary of State shall use the Federal | 22 | | Motor Carrier Safety Administration's "Best Practices and | 23 | | Recommendations" when drafting such rules.
