AMENDMENT TO HOUSE BILL 363

2    AMENDMENT NO. ______. Amend House Bill 363 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Employment of Illinois Workers on Public
5Works Act is amended by changing Section 1 and by adding
6Section 3.1 as follows:
 
7    (30 ILCS 570/1)  (from Ch. 48, par. 2201)
8    Sec. 1. Definitions. For the purposes of this Act, the
9following words have the meanings ascribed to them in this
10Section.
11    (1) "Illinois laborer" refers to any person who has
12resided in Illinois for at least 30 days and intends to become
13or remain an Illinois resident.
14    (2) "A period of excessive unemployment" means any month
15immediately following 2 consecutive calendar months during
16which the level of unemployment in the State of Illinois has

1exceeded 5% as measured by the United States Bureau of Labor
2Statistics in its monthly publication of employment and
3unemployment figures.
4    (3) "Hazardous waste" has the definition ascribed to it in
5Section 3.220 of the Illinois Environmental Protection Act,
6approved June 29, 1970, as amended.
7    (4) "Interested party" means a person or entity with an
8interest in compliance with this Act.
9    (5) "Entity" means any sole proprietor, partnership, firm,
10corporation, limited liability company, association, or other
11business enterprise; however, the term "entity" does not
12include (i) the State of Illinois or its officers, agencies,
13or political subdivisions or (ii) the federal government.
14    (6) "Public works" means any fixed work construction or
15improvement for the State of Illinois or any political
16subdivision of the State if that fixed work construction or
17improvement is funded or financed in whole or in part with
18State funds or funds administered by the State of Illinois.
19    (7) "Adequate welding standards" means specifications,
20guidelines, tests, and other methods used to ensure that all
21structural steel welds meet, at minimum, the codes and
22standards for such welds established in the welding code.
23    (8) "Certified welding inspector" means a person who is
24certified by the American Welding Society to inspect
25structural steel welding projects and conduct welder
26qualification tests.

1    (9) "Structural steel welding" means structural welds,
2weld repair, the structural system, and the welding of all
3primary steel members of a structure in accordance with the
4welding code. The term does not include welding that is
5required by the American Society of Mechanical Engineers to
6have its own certification.
7    (10) "Welding code" means the American Welding Society
8structural steel welding code D1.1, as in effect on July 1,
92023.
10    (11) "Department" means the Department of Labor.

13    Sec. 3.1. Contractors. A contractor whose workers are
14welding the structural steel on a public works project shall
15ensure that all of the following occur:
16        (1) the workers performing the structural steel
17    welding have been tested by and hold a valid certification
18    from a certified welding inspector;
19        (2) the structural steel welding performed for the
20    project meets adequate welding standards and is listed in
21    the project's job specifications; and
22        (3) the structural steel welding inspections listed in
23    the project's job specifications are completed by a
24    certified welding inspector.".
