| 1 | | AN ACT concerning education.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The School Code is amended by changing Section | 5 | | 10-23.13 as follows: | 6 | | (105 ILCS 5/10-23.13) | 7 | | Sec. 10-23.13. Policies addressing sexual abuse. | 8 | | (a) In this Section: | 9 | | "Evidence-informed" refers to modalities that were created | 10 | | utilizing components of evidence-based treatments or | 11 | | curriculums. | 12 | | "Grooming" means conduct prohibited under Section 11-25 of | 13 | | the Criminal Code of 2012. | 14 | | (b) To adopt and implement , by no later than July 1, 2022, | 15 | | a policy addressing sexual abuse of children that shall may | 16 | | include an age-appropriate and evidence-informed curriculum | 17 | | for students in pre-K through 12th 5th grade; | 18 | | evidence-informed training for school personnel on child | 19 | | sexual abuse; evidence-informed educational information to | 20 | | parents or guardians provided in the school handbook on the | 21 | | warning signs of a child being abused, along with any needed | 22 | | assistance, referral, or resource information; available | 23 | | counseling and resources for students affected by sexual |

| 1 | | abuse; and emotional and educational support for a child of | 2 | | abuse to continue to be successful in school. A school | 3 | | district shall include in its policy and all training | 4 | | materials and instruction a definition of prohibited grooming | 5 | | behaviors and boundary violations for school personnel and how | 6 | | to report these behaviors. | 7 | | Any policy adopted under this Section shall may address | 8 | | without limitation: | 9 | | (1) methods for increasing school personnel teacher , | 10 | | student, and parent awareness of issues regarding sexual | 11 | | abuse of children, including awareness and knowledge of | 12 | | likely warning signs indicating that a child may be a | 13 | | victim of sexual abuse , awareness and knowledge of | 14 | | grooming behaviors and how to report those behaviors, | 15 | | awareness of appropriate relationships between school | 16 | | personnel and students based on State law, and how to | 17 | | prevent child abuse from happening, including, but not | 18 | | limited to, methods outlined in State law regarding | 19 | | personal health and safety education for students ; | 20 | | (1.5) evidence-informed training for school personnel | 21 | | on preventing, recognizing, reporting, and responding to | 22 | | child sexual abuse and grooming behavior, including when | 23 | | the grooming or abuse is committed by a member of the | 24 | | school community, with a discussion of the criminal | 25 | | statutes addressing sexual conduct between school | 26 | | personnel and students, professional conduct, and |

| 1 | | reporting requirements, including, but not limited to, | 2 | | training as outlined in Section 10-22.39 and Section 3-11; | 3 | | (2) options actions that a student child who is a | 4 | | victim of sexual abuse has should take to obtain | 5 | | assistance and intervention; and | 6 | | (3) available counseling options for students affected | 7 | | by sexual abuse ; . | 8 | | (4) methods for educating school personnel, students, | 9 | | and staff on how to report child abuse to law enforcement | 10 | | authorities and to the Department of Children and Family | 11 | | Services and how to report grooming behaviors, including | 12 | | when the grooming or abuse is committed by a member of the | 13 | | school community; and | 14 | | (5) education and information about children's | 15 | | advocacy centers and sexual assault crisis centers and | 16 | | information about how to access a children's advocacy | 17 | | center or sexual assault crisis center serving the | 18 | | district. | 19 | | (c) A school district must provide training for school | 20 | | personnel on child sexual abuse as described in paragraph | 21 | | (1.5) of subsection (b) no later than January 31 of each year. | 22 | | (d) This Section may be referred to as Erin's Law.
