      625 ILCS 5/11-1520 new
          Amends the Illinois Vehicle Code.  Provides  that  it  is
      unlawful for a person under the age of 16 to operate or to be
      a  passenger  on  a  bicycle unless he or she wears a bicycle
      helmet.  Provides that a law enforcement agency shall impound
      the bicycle until it receives proof of ownership of a bicycle
      helmet.  Provides that it is unlawful for an  operator  of  a
      motorcycle  to  transport  a  passenger  under  the age of 16
      unless the passenger is wearing a motorcycle helmet.

 1        AN ACT to amend the Illinois  Vehicle  Code  by  changing
 2    Section 11-1404 and adding Section 11-1520.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The  Illinois  Vehicle  Code  is  amended  by
 6    changing  Section  11-1404  and  adding  Section  11-1520  as
 7    follows:
 8        (625 ILCS 5/11-1404) (from Ch. 95 1/2, par. 11-1404)
 9        Sec.   11-1404.  Special  equipment  for  persons  riding
10    motorcycles, motor driven cycles or motorized pedalcycles.
11        (a)  The operator of a motorcycle, motor driven cycle  or
12    motorized  pedalcycle  and  every  passenger thereon shall be
13    protected by glasses, goggles or a transparent shield.
14        (b)  For the purposes of this Section, glasses,  goggles,
15    and transparent shields are defined as follows:
16        "Glasses" means ordinary eye pieces such as spectacles or
17    sunglasses  worn  before  the  eye, made of shatter-resistant
18    material.  Shatter-resistant  material,  as  used   in   this
19    Section,  means  material  so  manufactured,  fabricated,  or
20    created  that  it substantially prevents shattering or flying
21    when struck or broken.
22        "Goggles" means  a  device  worn  before  the  eyes,  the
23    predominant  function of which is protecting the eyes without
24    obstructing  peripheral  vision.    Goggles   shall   provide
25    protection  from the front and sides, and may or may not form
26    a complete seal with the face.
27        "Transparent shield" means a windshield attached  to  the
28    front  of  a  motorcycle  that extends above the eyes when an
29    operator is seated in the normal,  upright  riding  position,
30    made  of  shatter-resistant  material, or a shatter-resistant
31    protective face shield that covers the wearer's eyes and face

 1    at least to a point approximately to the tip of the nose.
 2        (c)  Contact lenses are  not  acceptable  eye  protection
 3    devices.
 4        (d)  It  is  unlawful  for an operator of a motorcycle to
 5    transport  a  passenger  under  the  age  of  16  unless  the
 6    passenger is wearing a protective motorcycle helmet  of  good
 7    fit  fastened  securely  upon the head with the straps of the
 8    helmet.  The Department  of  Transportation  shall  establish
 9    rules setting standards for these motorcycle helmets.

12        Sec. 1520.  Bicycle helmet.
13        (a)  It  is  unlawful for a person under the age of 16 to
14    operate or to be a passenger on a bicycle unless at all times
15    when the person is so engaged he or she  wears  a  protective
16    bicycle  helmet  of  good fit fastened securely upon the head
17    with the straps of the helmet.
18        (b)  As used in this Section, "protective bicycle helmet"
19    means a piece of headgear that meets or  exceeds  the  impact
20    standards  for protective bicycle helmets set by the American
21    National Standards Institute (ANSI)  or  the  Snell  Memorial
22    Foundation.
23        (c)  For  a  violation of this Section, a law enforcement
24    agency shall impound the bicycle until  the  law  enforcement
25    agency   receives   satisfactory  proof  of  ownership  of  a
26    protective bicycle helmet of good fit or a person, other than
27    the operator or passenger of the bicycle or a  family  member
28    of  the operator or passenger, provides satisfactory proof of
29    ownership of the bicycle.  This is the  only  penalty  for  a
30    violation of this Section.
