LRB9000763DPcc HB0094 Enrolled LRB9000763DPcc 1 AN ACT to amend the Illinois Solid Waste Management Act 2 by adding Section 9. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Solid Waste Management Act is 6 amended by adding Section 9 as follows: 7 (415 ILCS 20/9 new) 8 Sec. 9. Market Development Pilot Program. 9 (a) The General Assembly finds and declares that: 10 (1) Since 1990, Illinois has taken steps to create 11 a market for secondary materials manufacturing 12 enterprises with the assistance of the Department of 13 Commerce and Community Affairs. 14 (2) The benefits of this market development have 15 included a 3-fold return on grant awards and loan 16 investments and a cleaner environment as a result of 17 increased recycling and increased job opportunities where 18 new locally-owned businesses have been created. 19 (3) Efforts to further develop this market are 20 needed to encourage increased use of recycled 21 commodities, develop strategies for transportation and 22 other market conditions, and aid with business and job 23 development in economically-depressed areas of our State. 24 (b) On or before June 30, 1999, the Department shall 25 create a 2-year market development pilot program to begin 26 operation on July 1, 1999 to expand the market of secondary 27 materials manufacturing enterprises that reuse or 28 remanufacture material that is collected under municipal and 29 business recycling programs. The Department shall: 30 (1) develop a 2-year strategic plan for market 31 development that shall assess existing market conditions, HB0094 Enrolled -2- LRB9000763DPcc 1 design methods to promote efficient collection and use of 2 recycled waste by municipalities and businesses, suggest 3 public and private sources of investment capital or funds 4 to develop enterprises that reuse or remanufacture 5 secondary materials, suggest methods of encouraging the 6 public to purchase and use products made from secondary 7 materials, and propose recommendations for legislation, 8 appropriations, or other public policies to aid in market 9 development in consultation with existing enterprises 10 that reuse or remanufacture secondary materials, 11 municipalities and businesses that participate in 12 recycling programs, environmental research organizations, 13 other states, and the public; and 14 (2) create a 2-year pilot financial assistance 15 program especially designed to develop secondary 16 materials manufacturing enterprises in 4 enterprise and 17 empowerment zones, located throughout Illinois, that 18 reuse or remanufacture material that is collected in 19 municipal and business recycling programs. 20 (A) The Department shall provide financial 21 assistance to the most viable proposals in the form 22 of low-interest loans or training grants. The size 23 and terms of a loan or grant shall be determined by 24 the Department. 25 (B) In determining the most viable proposals, 26 the Department may consider, among other things, the 27 nature of the business, capital and training needs, 28 program budget constraints, the type and amount of 29 materials that will be diverted from waste disposal, 30 and the impact on job creation in empowerment or 31 enterprise zones. 32 (3) The Department shall hold at least 2 33 informational meetings in the State to publicize the 34 existence of this market development program and the HB0094 Enrolled -3- LRB9000763DPcc 1 existence of the financial assistance program. The 2 Department shall provide technical assistance to 3 potential pilot program participants seeking assistance. 4 (4) The Department shall submit a report to the 5 General Assembly describing the results of the market 6 development program and including its 2-year strategic 7 plan by June 30, 2000 and report the results of its pilot 8 program by July 1, 2001. 9 Section 99. Effective date. This Act takes effect upon 10 becoming law.
