          Amends the Legislative  Materials  Act.   Authorizes  the
      Clerk  of the House, to the extent authorized by House Rules,
      to establish a schedule of reasonable fees to be  charged  to
      members  for  the  preparation,  filing,  and reproduction of
      non-substantive resolutions.   Amends  the  General  Assembly
      Compensation  Act to authorize members to pay resolution fees
      from their office allowances.  Effective immediately.

 1        AN ACT concerning fees of the Clerk of the House.
 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:
 4        Section  5.   The Legislative Materials Act is amended by
 5    changing Section 1 as follows:
 6        (25 ILCS 105/1) (from Ch. 63, par. 801)
 7        Sec. 1. Fees.
 8        (a)  The  Clerk  of  the  House  of  Representatives  may
 9    establish a schedule of reasonable fees  to  be  charged  for
10    providing  copies  of  daily  and  bound  journals, committee
11    documents,  committee   tape   recordings,   transcripts   of
12    committee  proceedings,  and committee notices, for providing
13    copies of bills on a continuing or individual basis, and  for
14    providing  tape  recordings  and transcripts of floor debates
15    and other proceedings of the House.
16        (b)  The Secretary of the Senate may establish a schedule
17    of reasonable fees to be  charged  for  providing  copies  of
18    daily  and  bound  journals, committee notices, for providing
19    copies of bills on a continuing or individual basis, and  for
20    providing  tape  recordings  and transcripts of floor debates
21    and other proceedings of the Senate.
22        (c)  The Clerk of the House of  Representatives  and  the
23    Secretary   of   the  Senate  may  establish  a  schedule  of
24    reasonable fees to be charged for  providing  live  audio  of
25    floor   debates   and  other  proceedings  of  the  House  of
26    Representatives and the Senate.  The Clerk and the  Secretary
27    shall  have complete discretion over the distribution of live
28    audio under this subsection (c),  including  discretion  over
29    the  conditions  under which live audio shall be distributed,
30    except that live audio shall be distributed  to  the  General
31    Assembly  and  its  staffs.   Nothing  in this subsection (c)

 1    shall be construed to create an obligation on the part of the
 2    Clerk or Secretary to provide live audio  to  any  person  or
 3    entity other than to the General Assembly and its staffs.
 4        (c-5)  The  Clerk of the House of Representatives, to the
 5    extent  authorized  by  the  House  Rules,  may  establish  a
 6    schedule of reasonable fees to be charged to members for  the
 7    preparation,  filing,  and  reproduction  of  non-substantive
 8    resolutions.
 9        (d)  Receipts from all fees established under subsections
10    (a),  (b), and (c), and (c-5) shall be deposited by the Clerk
11    and  the  Secretary  into  the  General  Assembly  Operations
12    Revolving Fund, a special fund in the State treasury. Amounts
13    in the Fund may be appropriated for  the  operations  of  the
14    offices  of the Clerk of the House of Representatives and the
15    Secretary of the Senate.

17        Section 10.  The General  Assembly  Compensation  Act  is
18    amended by changing Section 4 as follows:

20        Sec.  4.  Office allowance.  Beginning July 1, 1989, each
21    member of the  House  of  Representatives  is  authorized  to
22    approve the expenditure of not more than $47,000 per year and
23    each  member  of  the  Senate  is  authorized  to approve the
24    expenditure of not more than $57,000  per  year  to  pay  for
25    "personal  services",  "contractual services", "commodities",
26    "printing", "travel", "operation  of  automotive  equipment",
27    "telecommunications   services",  as  defined  in  the  State
28    Finance Act, and the compensation of one or more  legislative
29    assistants authorized pursuant to this Section, in connection
30    with his or her legislative duties and not in connection with
31    any   political  campaign.   A  member  may  purchase  office
32    equipment if the member certifies to  the  Secretary  of  the

 1    Senate  or  the  Clerk  of the House, as applicable, that the
 2    purchase price, whether paid in  lump  sum  or  installments,
 3    amounts  to less than would be charged for renting or leasing
 4    the equipment over its anticipated  useful  life.   All  such
 5    equipment  must  be  purchased  through  the Secretary of the
 6    Senate or the Clerk of the House, as applicable,  for  proper
 7    identification and verification of purchase.
 8        Each  member  of  the  General  Assembly is authorized to
 9    employ one or  more  legislative  assistants,  who  shall  be
10    solely  under  the  direction and control of that member, for
11    the purpose of assisting the member in the performance of his
12    or her official  duties.   A  legislative  assistant  may  be
13    employed pursuant to this Section either under contract or as
14    a  State  employee,  at  the  discretion  of  the  member. If
15    employed as a State employee, a legislative  assistant  shall
16    receive  employment benefits on the same terms and conditions
17    that apply to other employees of the General Assembly.
18        As used in this  Section  the  term  "personal  services"
19    shall  include  contributions  of the State under the Federal
20    Insurance Contribution  Act  and  under  Article  14  of  the
21    Illinois   Pension   Code.   As  used  in  this  Section  the
22    term"contractual services" shall not include improvements  to
23    real property unless those improvements are the obligation of
24    the lessee under the lease agreement. Beginning July 1, 1989,
25    as used in the Section, the term "travel" shall be limited to
26    travel  in  connection with a member's legislative duties and
27    not in connection with  any  political  campaign.   Beginning
28    July  1,  1989,  as used in this Section, the term "printing"
29    includes congratulatory mailings, including but  not  limited
30    to  greeting  or  welcome  messages,  anniversary or birthday
31    cards, and congratulations for prominent  achievement  cards.
32    As  used  in  this Section, the term "printing" includes fees
33    for non-substantive resolutions charged by the Clerk  of  the
34    House  of Representatives under subsection (c-5) of Section 1

 1    of the Legislative Materials Act.  Nothing  in  this  Section
 2    shall  be construed to authorize expenditures for lodging and
 3    meals while a member is in  attendance  at  sessions  of  the
 4    General Assembly.
 5        Any  utility  bill  for  service  provided  to a member's
 6    district  office  for  a  period  including  portions  of   2
 7    consecutive  fiscal years may be paid from funds appropriated
 8    for such expenditure in either fiscal year.
 9        If  a  vacancy  occurs  in  the  office  of  Senator   or
10    Representative  in the General Assembly, any office equipment
11    in the possession of the vacating member  shall  transfer  to
12    the  member's  successor; if the successor does not want such
13    equipment, it shall be transferred to the  Secretary  of  the
14    Senate  or Clerk of the House of Representatives, as the case
15    may be, and if not wanted by other  members  of  the  General
16    Assembly   then  to  the  Department  of  Central  Management
17    Services for treatment as surplus property  under  the  State
18    Property  Control Act. Each member, on or before June 30th of
19    each year,  shall  conduct  an  inventory  of  all  equipment
20    purchased  pursuant  to  this  Act.   Such inventory shall be
21    filed with the Secretary of the Senate or the  Clerk  of  the
22    House,  as  the  case  may be. Whenever a vacancy occurs, the
23    Secretary of the Senate or the Clerk of  the  House,  as  the
24    case   may  be,  shall  conduct  an  inventory  of  equipment
25    purchased.
26        In the event that a member leaves office  during  his  or
27    her  term,  any  unexpended  or  unobligated  portion  of the
28    allowance  granted  under  this  Section  shall  lapse.   The
29    vacating member's successor shall be granted an allowance  in
30    an  amount,  rounded  to  the  nearest  dollar,  computed  by
31    dividing  the  annual  allowance  by  365 and multiplying the
32    quotient by the number of days remaining in the fiscal year.
33        From any appropriation for the purposes of  this  Section
34    for  a  fiscal  year  which overlaps 2 General Assemblies, no

 1    more than 1/2 of the annual allowance per member may be spent
 2    or encumbered  by  any  member  of  either  the  outgoing  or
 3    incoming  General  Assembly,  except  that  any member of the
 4    incoming General Assembly who was a member  of  the  outgoing
 5    General  Assembly  may  encumber  or spend any portion of his
 6    annual allowance within the fiscal year.
 7        The appropriation for the annual allowances permitted  by
 8    this  Section  shall  be  included in an appropriation to the
 9    President of the Senate and to the Speaker of  the  House  of
10    Representatives  for their respective members.  The President
11    of the Senate and the Speaker of the House shall voucher  for
12    payment  individual  members'  expenditures from their annual
13    office allowances to the State Comptroller,  subject  to  the
14    authority  of  the  Comptroller  under Section 9 of the State
15    Comptroller Act.

17        Section 99.  Effective date.  This Act takes effect  upon
18    becoming law.
