Prohibits the expenditure of or a loan of campaign funds for any personal use unrelated to a political campaign involving a candidate or question of public policy. Defines "personal use". Effective January 1, 1998. LRB9001971MWpcA LRB9001971MWpcA 1 AN ACT to amend the Election Code by adding Sections 2 9-25.2 and 9-25.3. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Election Code is amended by adding 6 Section 9-25.2 and 9-25.3 as follows: 7 (10 ILCS 5/9-25.2 new) 8 Sec. 9-25.2. Personal use of campaign funds. 9 (a) As used in this Section, "personal use" means a use 10 that primarily furthers individual or family purposes not 11 connected with the performance of duties or activities as a 12 candidate for any office covered in this Article and includes 13 the personal use of an asset purchased with the contribution 14 and the personal use of any interest or other income earned 15 on the contribution. It does not include payments made to 16 defray ordinary and necessary expenses incurred in connection 17 with a question of public policy to be placed on the ballot. 18 (b) A person who accepts a political contribution as a 19 candidate, agent, or officer of a political committee shall 20 not convert the contribution to personal use. 21 (c) Campaign funds shall not be used or loaned by any 22 person for any personal use unrelated to a political campaign 23 involving a candidate or question of public policy. 24 (Source: P.A. 89-405, eff. 11-8-95.) 25 (10 ILCS 5/9-25.3 new) 26 Sec. 9-25.3 Contributions to be used only for ordinary 27 and necessary expenses. No person shall make an expenditure 28 of or loan campaign funds for any purpose other than ordinary 29 and necessary expenses incurred in connection with a campaign 30 for elective office or in connection with a question of -2- LRB9001971MWpcA 1 public policy to be placed on the ballot. 2 Section 99. Effective date. This Act takes effect 3 January 1, 1998.
