Provides that an Internet service provider must give each of its customers in this State the option of canceling service on 10 days' notice to the Internet service provider. Provides that an Internet service provider must provide the customer with a form and a pre-addressed envelope that the customer may use to cancel service by U.S. Postal Service mail. Specifies methods for providing the form and pre-addressed envelope to the customer. Provides that an Internet service provider who violates any of these provisions commits an unlawful practice within the meaning of the Act. LRB9001450WHmg LRB9001450WHmg 1 AN ACT to amend the Consumer Fraud and Deceptive Business 2 Practices Act by adding Section 2EE. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Consumer Fraud and Deceptive Business 6 Practices Act is amended by adding Section 2EE as follows: 7 (815 ILCS 505/2EE new) 8 Sec. 2EE. Internet service providers. An Internet 9 service provider must give each of its customers in this 10 State the option of canceling service on 10 days' notice to 11 the Internet service provider. The Internet service provider 12 must provide the customer with a form and a pre-addressed 13 envelope that the customer may use to cancel service by U.S. 14 Postal Service mail. In the case of any customer who is 15 billed by U.S. Postal Service Mail for each billing period, 16 the Internet service provider must include the form and the 17 pre-addressed envelope with each bill sent to the customer. 18 In the case of any customer who is billed by means of 19 electronic mail reminders or who is automatically billed by 20 credit card, automatic bank account deduction, or some other 21 automatic method, the Internet service provider must provide 22 the form and the pre-addressed envelope to the customer 23 within 10 days after the account is opened (or, in the case 24 of any existing customer, within 10 days after the effective 25 date of this amendatory Act of 1997). An Internet service 26 provider who violates any provision of this Section commits 27 an unlawful practice within the meaning of this Act. 28 As used in this Section, "Internet service provider" 29 means a person who provides to a customer, for a fee or 30 charge, access (regardless of whether the access is through 31 an online service that provides other services that are not -2- LRB9001450WHmg 1 part of the Internet) on an ongoing basis to Internet 2 electronic mail, the World Wide Web, Internet file transfers, 3 or any other information or data that may be sent or received 4 through the Internet.
