110 ILCS 805/2-11.5
Amends the Public Community College Act and the Illinois
State University Law. Effective July 1, 1997, abolishes the
Illinois Institute for Entrepreneurship Education as created
and functioning within the Illinois Community College Board,
terminates the terms of its 18 member Board, and recreates
the Institute, as a successor to the predecessor Institute,
with a new 15 member Board within Illinois State University.
Provides for transfer of all powers, duties, records, and
property of the predecessor Institute to the successor
Institute as of July 1, 1997. Effective immediately.

1 AN ACT relating to the Illinois Institute for
2 Entrepreneurship Education, amending named Acts.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois State University Law is amended
6 by adding Section 20-115 as follows:
7 (110 ILCS 675/20-115 new)
8 Sec. 20-115. Illinois Institute for Entrepreneurship
9 Education.
10 (a) There is created, effective July 1, 1997, within the
11 State at Illinois State University, the Illinois Institute
12 for Entrepreneurship Education, hereinafter referred to as
13 the Institute.
14 (b) The Institute created under this Section shall
15 commence its operations on July 1, 1997 and shall have a
16 board composed of 15 members representative of education,
17 commerce and industry, government, or labor, appointed as
18 follows: 2 members shall be appointees of the Governor, one
19 of whom shall be a minority or female person as defined in
20 Section 2 of the Business Enterprise for Minorities, Females,
21 and Persons with Disabilities Act; one member shall be an
22 appointee of the President of the Senate; one member shall be
23 an appointee of the Minority Leader of the Senate; one
24 member shall be an appointee of the Speaker of the House of
25 Representatives; one member shall be an appointee of the
26 Minority Leader of the House of Representatives; 2 members
27 shall be appointees of Illinois State University; one member
28 shall be an appointee of the Board of Higher Education; one
29 member shall be an appointee of the State Board of Education;
30 one member shall be an appointee of the Department of
31 Commerce and Community Affairs; one member shall be an

1 appointee of the Illinois chapter of Economics America; and 3
2 members shall be appointed by majority vote of the other 12
3 appointed members to represent business owner-entrepreneurs.
4 Each member shall have expertise and experience in the area
5 of entrepreneurship education, including small business and
6 entrepreneurship. The majority of voting members must be
7 from the private sector. The members initially appointed to
8 the board of the Institute created under this Section shall
9 be appointed to take office on July 1, 1997 and shall by lot
10 determine the length of their respective terms as follows: 5
11 members shall be selected by lot to serve terms of one year,
12 5 members shall be selected by lot to serve terms of 2 years,
13 and 5 members shall be selected by lot to serve terms of 3
14 years. Subsequent appointees shall each serve terms of 3
15 years. The board shall annually select a chairperson from
16 among its members. Each board member shall serve without
17 compensation but shall be reimbursed for expenses incurred in
18 the performance of his or her duties.
19 (c) The purpose of the Institute shall be to foster the
20 growth and development of entrepreneurship education in the
21 State of Illinois. The Institute shall help remedy the
22 deficiencies in the preparation of entrepreneurship education
23 teachers, increase the quality and quantity of
24 entrepreneurship education programs, improve instructional
25 materials, and prepare personnel to serve as leaders and
26 consultants in the field of entrepreneurship education and
27 economic development. The Institute shall promote
28 entrepreneurship as a career option, promote and support the
29 development of innovative entrepreneurship education
30 materials and delivery systems, promote business, industry,
31 and education partnerships, promote collaboration and
32 involvement in entrepreneurship education programs, encourage
33 and support in-service and preservice teacher education
34 programs within various educational systems, and develop and

1 distribute relevant materials. The Institute shall provide a
2 framework under which the public and private sectors may work
3 together toward entrepreneurship education goals. These
4 goals shall be achieved by bringing together programs that
5 have an impact on entrepreneurship education to achieve
6 coordination among agencies and greater efficiency in the
7 expenditure of funds.
8 (d) Beginning July 1, 1997, the Institute shall have the
9 following powers subject to State and Illinois State
10 University Board of Trustees regulations and guidelines:
11 (1) To employ and determine the compensation of an
12 executive director and such staff as it deems necessary;
13 (2) To own property and expend and receive funds
14 and generate funds;
15 (3) To enter into agreements with public and
16 private entities in the furtherance of its purpose; and
17 (4) To request and receive the cooperation and
18 assistance of all State departments and agencies in the
19 furtherance of its purpose.
20 (e) The board of the Institute shall be a policy making
21 body with the responsibility for planning and developing
22 Institute programs. The Institute, through the Board of
23 Trustees of Illinois State University, shall annually report
24 to the Governor and General Assembly by January 31 as to its
25 activities and operations, including its findings and
26 recommendations.
27 (f) Beginning on July 1, 1997, the Institute created
28 under this Section shall be deemed designated by law as the
29 successor to the Illinois Institute for Entrepreneurship
30 Education, previously created and existing under Section
31 2-11.5 of the Public Community College Act until its
32 abolition on July 1, 1997 as provided in that Section. On
33 July 1, 1997, all financial and other records of the
34 Institute so abolished and all of its property, whether real

1 or personal, including but not limited to all inventory and
2 equipment, shall be deemed transferred by operation of law to
3 the Illinois Institute for Entrepreneurship Education created
4 under this Section 20-115. The Illinois Institute for
5 Entrepreneurship Education created under this Section 20-115
6 shall have, with respect to the predecessor Institute so
7 abolished, all authority, powers, and duties of a successor
8 agency under Section 10-15 of the Successor Agency Act.

10 Section 10. The Public Community College Act is amended
11 by changing Section 2-11.5 as follows:

10 chapter of Economics America. Each member shall have

8 or personal, including but not limited to all inventory and
9 equipment, shall be deemed transferred by operation of law to
10 the Illinois Institute for Entrepreneurship Education created
11 under this Section 2-11.5. The Illinois Institute for
12 Entrepreneurship Education created under this Section 2-11.5
13 shall have, with respect to the predecessor Institute so
14 abolished, all authority, powers, and duties of a successor
15 agency under Section 10-15 of the Successor Agency Act.
16 (g) The Institute created under this Section is
17 abolished on July 1, 1997, and the terms of the members of
18 the board of the Institute so abolished are terminated on
19 that date. All financial and other records of the Institute
20 so abolished and all of the property of that former
21 Institute, whether real or personal in nature, including but
22 not limited to all inventory and equipment, shall be deemed
23 transferred on July 1, 1997, by operation of law, to the
24 Illinois Institute for Entrepreneurship Education created
25 under Section 20-115 of the Illinois State University Law as
26 the successor of the Institute that is abolished as provided
27 in this Section 2-11.5.
28 (h) Subsections (a) through (f) of this Section 2-11.5
29 shall have no legal force or effect from and after July 1,
30 1997.
31 (i) This Section is repealed on July 31, 1997.

33 Section 99. Effective date. This Act takes effect upon
