Provides that the Office of the State Fire Marshall shall require identifying emblems on buildings that have a roof or floor with truss construction. Provides that the county in unincorporated areas and the municipality in incorporated areas shall enforce the Act and authorizes the county or municipality to charge a reasonable registration fee for buildings requiring the emblem. LRB9003879PTcw HB0768 Enrolled LRB9003879PTcw 1 AN ACT concerning fire safety. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Truss Construction Fire Safety Act. 6 Section 5. Definitions. For the purposes of this Act: 7 "Truss" means a framed structural unit made up of a group 8 of triangles arranged in a single plane in such a manner that 9 if loads are applied at the points of intersection of the 10 truss members, only compressive or tensile (nonbending) 11 forces will result in the members. 12 "Truss construction" means a structure, excluding a 13 residential structure, in which the roof or floor is 14 supported by trusses. 15 Section 10. Display requirement. 16 (a) A municipality may by ordinance require that a truss 17 construction emblem be affixed to the front of all or any 18 class of structures, excluding residential structures, within 19 the municipality that have truss construction. 20 (b) A county may by ordinance require that a truss 21 construction emblem be affixed to the front of all or any 22 class of structures, excluding residential structures, within 23 the unincorporated area of the county that have truss 24 construction. 25 (c) Where individual structures, excluding residential 26 structures, with truss construction are part of a planned 27 unit development or subdivision, the municipality or county 28 may require the truss construction emblem to be displayed at 29 each entrance to the development or subdivision rather than 30 on each individual structure. Registration requirement; fee. 2 (a) A municipality or county that requires display of a 3 truss construction emblem on all or any class of structures, 4 excluding residential structures, may require the owners of 5 those structures to register them with the fire department or 6 other appropriate agency of the municipality or county. 7 (b) The municipality or county may charge a reasonable 8 registration fee to the owners of structures that are 9 required to be registered under subsection (a). These fees 10 shall be used for reasonable costs related to identifying, 11 maintaining records of, and inspecting structures with truss 12 construction; and any other costs of implementing, 13 administering, or enforcing an ordinance adopted under this 14 Act. 15 Section 20. Truss construction emblem. 16 (a) The truss construction emblem shall have a bright 17 and reflective color or be made of reflective material. The 18 shape of the emblem shall be an isosceles triangle and the 19 size shall be 12 inches horizontally by 6 inches vertically. 20 The following letters shall be printed on the emblem in a 21 conspicuous size and color: 22 "F" to signify a floor with truss construction; 23 "R" to signify a roof with truss construction; and 24 "F/R" to signify both a floor and roof with truss 25 construction. 26 (b) The emblem shall be permanently affixed to the left 27 of the main entrance door at a height between 4 and 6 feet 28 above the ground and shall be installed and maintained by the 29 building owner. 30 Section 99. Effective date. This Act takes effect upon 31 becoming law.
