90_HB0789 220 ILCS 5/7-102.5 new Amends the Public Utilities Act. Prohibits gas and electric public utilities from subsidizing nonutility services with funds received under regulated rates. LRB9001980JSgcB LRB9001980JSgcB 1 AN ACT to amend the Public Utilities Act by adding 2 Section 7-102.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Utilities Act is amended by adding 6 Section 7-102.5 as follows: 7 (220 ILCS 5/7-102.5 new) 8 Sec. 7-102.5. Subsidization of nonutility services 9 prohibited. A rate-regulated gas or electric public utility 10 may not directly or indirectly include any costs or expenses 11 attributable to providing nonutility service in regulated 12 rates or charges. A rate-regulated gas or electric public 13 utility or its affiliates may not use vehicles, service 14 tools, equipment, instruments, billing systems, customer 15 information or marketing programs, or employees for which 16 costs, salaries, or benefits are recoverable in the regulated 17 rates for electric service or gas service, or revenues 18 derived from the regulated rates, to install, service, or 19 repair residential, commercial, or industrial gas or electric 20 heating, ventilating, or air conditioning systems, or 21 interior load side lighting systems and fixtures or sell at 22 retail heating, ventilating, air conditioning, or interior 23 lighting equipment. 24 For the purposes of this Section "nonutility service" 25 includes, but is not limited to, the sale, lease, 26 installation, or other conveyance of industrial, commercial, 27 or residential gas or electric appliances, load side 28 electrical systems, including fixtures and components, steel 29 fabrication, and heating, ventilating, or air conditioning 30 systems and component parts for the service, repair, 31 installation, or maintenance of any of these items. For the -2- LRB9001980JSgcB 1 purposes of this Section, "commercial" means a place of 2 business primarily used for the storage or sale, at wholesale 3 or retail, of goods, wares, services, or merchandise. For 4 the purposes of this Section, "industrial" means a place of 5 business primarily used for the manufacture, assembly, or 6 distribution of goods, wares, services, or merchandise. 7 Nothing in this Section shall be construed to prohibit a 8 regulated gas or electric public utility from using its 9 utility vehicles, service tools and instruments, and 10 employees to market utility systems, services, and equipment, 11 to light pilots, or to eliminate a customer emergency or 12 threat to public safety.
