      305 ILCS 5/4-7            from Ch. 23, par. 4-7
          Amends  the  Public  Aid  Code.    Requires   that   AFDC
      applicants and recipients authorize home visits in connection
      with  determining initial and continuing eligibility for aid.
      Requires the Department of Human Services, as  the  successor
      agency  to  the  Department  of Public Aid for the purpose of
      administering the AFDC program, to establish  a  program  for
      conducting  home  visits  and  using  information  from other
      sources. Authorizes the Department to delegate the  provision
      of services to other appropriate agencies.

 1        AN  ACT to amend the Illinois Public Aid Code by changing
 2    Section 4-7.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Illinois Public Aid Code is amended by
 6    changing Section 4-7 as follows:
 7        (305 ILCS 5/4-7) (from Ch. 23, par. 4-7)
 8        Sec. 4-7. Home  visits,  interviews,  or  communications.
 9    Each  family  receiving aid shall be interviewed in person or
10    communicated with, in a home visit or  by  other  appropriate
11    means, in investigations of applications for aid and at least
12    once   in  each  subsequent  12  month  period  to  ascertain
13    continuing need for such aid and to provide the child and his
14    parents or relatives with such service and guidance  as  will
15    strengthen  family  life  and  aid  them  in utilizing to the
16    maximum their capacities  for  self-care,  self-support,  and
17    responsible  citizenship.    However, the Illinois Department
18    shall determine those assistance units where the  possibility
19    for  public  assistance  fraud or abuse is greatest, or where
20    there is the possibility  of  frequent  changes  in  need  or
21    circumstances,  or  where  any  child  in  the home may be an
22    abused or neglected child as determined by the Department  of
23    Children  and  Family Services under the Abused and Neglected
24    Child Reporting Act, as now or hereafter amended,  and  shall
25    by   rule   provide   for  more  frequent  interviews  of  or
26    communications  with  those  assistance  units  and  for  the
27    implementation of necessary remedies under Sections  4-8  and
28    4-9   for   those  assistance  units.    As  a  condition  of
29    eligibility for aid, an applicant for  or  recipient  of  aid
30    must  (i)  authorize  a  home  visit  in  connection with the
31    initial determination of eligibility and, in connection  with

 1    a  determination  of continuing eligibility, at least once in
 2    every 12-month  period  thereafter  as  long  as  the  family
 3    continues  to  receive aid and (ii) allow a representative of
 4    the  Illinois  Department  access  to  the   applicant's   or
 5    recipient's  home  for  the  purpose  of  conducting the home
 6    visit.    The   Illinois   Department   shall   adopt   rules
 7    establishing a program for conducting home visits as required
 8    under this Section and for using appropriate information from
 9    other sources in determining the occasion  and  frequency  of
10    home  visits.   The  program  shall  provide for the Illinois
11    Department's delegation to other appropriate agencies of  the
12    authority  to  provide  appropriate  services  to the family,
13    based on information  received  by  the  Illinois  Department
14    during  the  course  of  a  home  visit or other interview or
15    communication or from other sources. Written reports of  such
16    interviews  or  communications and any related remedies shall
17    become a part of the record in every case.
