Amend House Bill 1058, AS AMENDED, 3 by replacing the title with the following: 4 "AN ACT concerning transportation, amending named Acts."; 5 and 6 below the end of Section 5, by inserting the following: 7 "Section 10. The Illinois Vehicle Code is amended by 8 adding Section 1-159.9 and changing Sections 1-191 and 3-812 9 as follows: 10 (625 ILCS 5/1-159.9 new) 11 Sec. 1-159.9. Permanently mounted equipment. Any 12 vehicle which has 2 separate power sources, one power source 13 primarily to supply motive force to the drive wheels and one 14 power source primarily to operate the mounted equipment. Any 15 vehicle together with an apparatus or instrument permanently 16 affixed shall not be used to transport cargo or properties 17 which are not used in the direct operation of the permanently 18 mounted equipment. Permanently mounted equipment includes 19 vehicles to which a crane, other apparatus, or instrument has 20 been permanently attached; designed and used to perform 21 specific tasks: drilling, digging, lifting, mining, and other -2- LRB9003740NTksam 1 such tasks. This definition shall not include equipment 2 which could function without being permanently mounted. 3 (625 ILCS 5/1-191) (from Ch. 95 1/2, par. 1-191) 4 Sec. 1-191. Special mobile equipment. Every vehicle not 5 designed or used primarily for the transportation of persons 6 or property and only incidentally operated or moved over a 7 highway, including but not limited to: street sweepers, ditch 8 digging apparatus, well boring apparatus and road 9 construction and maintenance machinery such as asphalt 10 spreaders, bituminous mixers, bucket loaders, tractors other 11 than truck tractors, ditchers, levelling graders, finishing 12 machines, motor graders, road rollers, scarifiers, earth 13 moving carryalls and scrapers, power shovels and drag lines, 14 and self-propelled cranes and earth moving equipment. The 15 term does not include house trailers, dump trucks, truck 16 mounted transit mixers, truck mounted cranes,ortruck 17 mounted shovels, or other vehicles designed for the 18 transportation of persons or property to which machinery has 19 been attached. 20 (Source: P.A. 85-951.) 21 (625 ILCS 5/3-812) (from Ch. 95 1/2, par. 3-812) 22 Sec. 3-812. Vehicles with Permanently Mounted Equipment 23 - Registration Fees.
