90_HB1083 225 ILCS 207/45 Amends the Commercial and Public Building Asbestos Abatement Act to require Department-approved asbestos abatement contractors to carry liability insurance in an amount of at least $500,000 (now, $1,000,000). Disallows group insurance under that requirement. Effective immediately. LRB9004103DPcc LRB9004103DPcc 1 AN ACT to amend the Commercial and Public Building 2 Asbestos Abatement Act by changing Section 45. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Commercial and Public Building Asbestos 6 Abatement Act is amended by changing Section 45 as follows: 7 (225 ILCS 207/45) 8 Sec. 45. Asbestos abatement contractor's certificate of 9 financial responsibility. Each asbestos abatement contractor 10 that wishes to be placed on the Department's approved list of 11 asbestos abatement contractors shall submit to the Department 12 a certificate documenting that the contractor carries 13 liability insurance from a company with at least an "A" 14 rating accorded by A.M. Best & Co. or,self insurance, group15insurance, or group self insurancein an amount of at least 16 $500,000$1,000,000for work performed pursuant to this Act 17 and the rules promulgated under it. No asbestos abatement 18 contractor may be placed on the approved list in the absence 19 of such a certificate. All asbestos abatement contractors 20 presently licensed by the Department in accordance with the 21 Asbestos Abatement Act for public and private schools in 22 Illinois who wish to be on the approved list shall submit the 23 certificate within 90 days of the effective date of this Act. 24 Each asbestos abatement contractor shall maintain on file 25 with the Department a current certificate of financial 26 responsibility throughout the entire length of time the 27 contractor's name appears on the Department's list of 28 approved contractors. An asbestos abatement contractor shall 29 notify the Department of any change in the status of a 30 certificate that has been filed including expiration, 31 renewal, or alteration of the terms of the certificate. -2- LRB9004103DPcc 1 (Source: P.A. 89-143, eff. 7-14-95.) 2 Section 99.
