      605 ILCS 5/5-101.12 new
          Amends the Illinois Highway Code to provide that a county
      board  may  treat  the  construction   and   maintenance   of
      sidewalks, public transportation loading and unloading areas,
      and  off-street  parking  facilities  upon  or  adjacent to a
      county highway as a road purpose as part of the  construction
      or maintenance of a county highway.

 1        AN  ACT  to  amend  the Illinois Highway Code by changing
 2    Section 5-101 and adding Section 5-101.12.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Illinois  Highway  Code  is amended by
 6    changing  Section  5-101  and  adding  Section  5-101.12   as
 7    follows:
 8        (605 ILCS 5/5-101) (from Ch. 121, par. 5-101)
 9        Sec.  5-101.  The  county board of each county shall have
10    the powers and duties stated in Sections 5-101.1 to  5-101.12
11    5-101.11, inclusive.

14        Sec.  5-101.12.  In  counties  that  are  contiguous to a
15    county with a population of more than 3,000,000, to treat the
16    construction   and   maintenance   of    sidewalks,    public
17    transportation   loading   and  unloading  areas,  off-street
18    parking facilities, and any  related  appurtenances  upon  or
19    adjacent to a county highway as a road purpose as part of the
20    construction  or  maintenance  of a county highway under this
21    Code. Nothing in this Section shall be construed to require a
22    county board to comply with this Section.
