Amend House Bill 1135 by replacing 3 the title with the following: 4 "AN ACT to amend the Higher Education Student Assistance 5 Act by adding Section 38."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Higher Education Student Assistance Act 9 is amended by adding Section 38 as follows: 10 (110 ILCS 947/38 new) 11 Sec. 38. Illinois resident scholarship program. 12 (a) A person who is a resident of Illinois, who is a 13 citizen of the United States, and who is accepted for 14 admission to an "institution of higher learning" (as that 15 term is defined in Section 10 of this Act) is eligible for a 16 scholarship under this Section when the Commission finds: 17 (1) in the case of a scholarship applicant who is 18 claimed as a dependent for federal income tax purposes 19 for the calendar year immediately preceding the calendar 20 year in which commences the academic year during which 21 the scholarship is to be effective, that the aggregate -2- LRB9004972THmgam 1 adjusted gross incomes for federal income tax purposes 2 for that immediately preceding calendar year of the 3 scholarship applicant and his or her parents or legal 4 guardians are less than $75,000; or 5 (2) in the case of a scholarship applicant who is 6 not claimed as a dependent for federal income tax 7 purposes for the calendar year immediately preceding the 8 calendar year in which commences the academic year during 9 which the scholarship is to be effective and who may not 10 be claimed as a dependent for federal income tax purposes 11 for the calendar year in which that academic year 12 commences, that the total adjusted gross income for 13 federal income tax purposes for that immediately 14 preceding calendar year of the scholarship applicant (or 15 the applicant and his or her spouse if the applicant was 16 married during that preceding calendar year) is less than 17 $25,000. 18 (b) Each scholarship awarded under this Section (i) 19 shall be in an amount sufficient to pay 50% of the 20 applicant's "tuition and other necessary fees" (as that term 21 is defined in Section 35 of this Act) at the institution of 22 higher learning in which the applicant enrolls, up to a 23 maximum of $1,000 per academic year; (ii) shall be applicable 24 toward 2 semesters or 3 quarters of enrollment within that 25 academic year, and (iii) shall be reduced by the amount or 26 value of any other scholarship, grant, or tuition waiver that 27 is received by the scholarship applicant and effective during 28 that academic year, if the scholarship or grant is to be paid 29 to or on behalf of the applicant from appropriated public 30 funds or if the tuition waiver is to be used at a public 31 university or public community college of this State. 32 (c) No person may receive more than 8 semesters or 12 33 quarters of scholarship assistance under this Section. 34 (d) All scholarship funds distributed under this Section -3- LRB9004972THmgam 1 shall be paid by the Commission directly to the institution 2 of higher learning at which the scholarship recipient is an 3 enrolled student. 4 (e) All applications for scholarship assistance to be 5 awarded under this Section shall be made to the Commission on 6 forms prescribed by the Commission. The Commission shall 7 require scholarship applicants to submit with their 8 applications such supporting documents as the Commission 9 deems necessary. 10 Section 99. Effective date. This Act takes effect July 11 1, 1997.".
