Provides that, upon request, the Department shall conduct presentations on energy efficiency matters. Requires the Department to distribute the fact sheets to all mortgage lenders in Illinois. Requires the mortgage lenders to make the fact sheets available to the public. LRB9004207JSgc HB1297 Engrossed LRB9004207JSgc 1 AN ACT to amend the Civil Administrative Code of Illinois 2 by adding Section 46.69. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Civil Administrative Code of Illinois is 6 amended by adding Section 46.69 as follows: 7 (20 ILCS 605/46.69 new) 8 Sec. 46.69. Residential energy efficiency. 9 (a) The Department shall develop an energy efficiency 10 rating (EER) fact sheet for distribution to purchasers of 11 residential property. The Department shall obtain input from 12 state-wide lender associations, housing advocacy groups, 13 appraisers, energy rating organizations, realtors, and other 14 interested parties in developing the EER fact sheet. 15 (b) The EER fact sheet shall provide basic information 16 on the concept of energy efficiency rating. The EER fact 17 sheet shall include an example demonstrating energy 18 consumption and cost for a residence both before and after 19 improvements to enhance energy efficiency. The EER fact 20 sheet shall emphasize the importance of an efficiency 21 analysis to estimate the cost savings that may result from 22 improvements. It shall provide recommendations of various 23 methodologies that may be utilized to enhance the energy 24 efficiency of residences. 25 (c) The Department shall distribute to all mortgage 26 lenders, as defined in the Mortgage Escrow Account Act, EER 27 fact sheets in an amount equal to the number of mortgage 28 applications distributed by the mortgage lender during the 29 previous calendar year. 30 (d) The Department shall establish a dedicated telephone 31 line to receive questions from lenders and prospective HB1297 Engrossed -2- LRB9004207JSgc 1 mortgagees regarding energy efficiency concerns. This phone 2 line may be used with an automatic answering system only 3 during hours the Department is not open for regular services 4 to the public. In addition, the Department shall, upon 5 request from a mortgage lender, make presentations concerning 6 energy efficiency in the Legislative District in which the 7 lender is located. The presentation shall be held within 90 8 days after the request and shall be open to the public. 9 (e) A mortgage lender, as defined in the Mortgage Escrow 10 Account Act, shall display the EER fact sheets at each 11 location at which it conducts business. The EER fact sheets 12 shall be available in a self-service format. A mortgage 13 lender shall also include an EER fact sheet in all loan 14 application packages distributed by the lender.
