      225 ILCS 46/80 new
          Amends the Health Care Worker  Background  Check  Act  to
      require  the  Department on Aging and the Department of Human
      Services  to  develop  and  implement  a  home  care   worker
      background   check   program  on  or  before  July  1,  1998.
      Requires the Departments to jointly report  to  the  Governor
      and  the General Assembly concerning the effectiveness of the
      program.

 1        AN ACT to amend the Health Care Worker  Background  Check
 2    Act by adding Section 80.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Health Care Worker Background  Check  Act
 6    is amended by adding Section 80 as follows:
 7        (225 ILCS 46/80 new)
 8        Sec.  80.  Home  Care  Worker  Background  Check.   On or
 9    before  July  1,  1998,  the  Department  on  Aging  and  the
10    Department of Human Services, with  the  cooperation  of  the
11    Department  of  Public  Health, shall develop and implement a
12    process for conducting background checks on  persons  seeking
13    employment  as  home care workers in this State, based on the
14    process used by the Department of Public  Health  under  this
15    Act.   As  used  in  this Section, "home care worker" means a
16    person who provides services described under the Illinois Act
17    on the Aging and the Disabled Persons Rehabilitation  Act  on
18    contract or through a service agency at a person's residence.
19    On  or before July 1, 1999, the Director of the Department on
20    Aging and the Secretary of the Department of  Human  Services
21    shall jointly report to the Governor and the General Assembly
22    concerning  the effectiveness and desirability of a home care
23    worker background check program.
