Amends the Consumer Fraud and Deceptive Business
Practices Act. Prohibits a seller of merchandise from
selling warranties or repair contracts issued by the seller
or an affiliate of the seller unless the seller agrees to
repair or replace the merchandise within 30 days after it is
presented for repair.

1 AN ACT to amend the Consumer Fraud and Deceptive Business
2 Practices Act by adding Section 2EE.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Consumer Fraud and Deceptive Business
6 Practices Act is amended by adding Section 2EE as follows;
7 (815 ILCS 505/2EE new)
8 Sec. 2EE. Product warranties. A person engaged in the
9 business of selling merchandise may not, in connection with
10 the sale of that merchandise, sell a warranty or repair
11 contract issued by the person or an affiliate of the person
12 unless the person agrees to repair or replace the merchandise
13 subject to the warranty or repair contract within 30 days
14 after the merchandise is presented for repair or replacement
15 under the terms of the warranty or repair contract.
