      New Act
          Creates  the  Grape  and  Wine  Resources  Council   Act.
      Creates a short title only.

 1        AN  ACT  in  relation to the regulation of wine, amending
 2    named Acts.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  State Finance Act is amended by adding
 6    Section 5.449 as follows:
 7        (30 ILCS 105/5.449 new)
 8        Sec. 5.449.  The Grape and Wine Resources Fund.
 9        Section 10.  The Liquor Control Act of 1934 is amended by
10    adding Section 1-3.37 and Article XII as follows:
11        (235 ILCS 5/1-3.37 new)
12        Sec.  1-3.37.  "Council"  means  the   Grape   and   Wine
13    Resources Council.

15           ARTICLE XII.  GRAPE AND WINE RESOURCES COUNCIL

17        Sec. 12-1.  Grape and Wine Resources Council.
18        (a)  There is hereby created the Grape and Wine Resources
19    Council,  which shall have the powers and duties specified in
20    this Article and all other powers  necessary  and  proper  to
21    execute the provisions of this Article.
22        (b)  The Council shall consist of 13 members including:
23             (1)  The  Director  of  the  Illinois  Department of
24        Agriculture, ex officio, or the Director's designee.
25             (2)  The Dean of the SIU College of Agriculture,  or
26        the Dean's designee.
27             (3)  The  Dean of the University of Illinois College

 1        of Agriculture, or the Dean's designee.
 2             (4)  An  expert  in  enology  or  food  science  and
 3        nutrition to be named by the  Director  of  the  Illinois
 4        Department  of  Agriculture  from  nominations  submitted
 5        jointly  by  the  Deans of the Colleges of Agriculture at
 6        Southern  Illinois  University  and  the  University   of
 7        Illinois.
 8             (5)  An  expert  in  marketing  to  be  named by the
 9        Director of the Illinois Department of  Agriculture  from
10        nominations   submitted  jointly  by  the  Deans  of  the
11        Colleges of Agriculture at Southern  Illinois  University
12        and the University of Illinois.
13             (6)  An  expert  in  viticulture  to be named by the
14        Director of the Illinois Department of  Agriculture  from
15        nominations   submitted  jointly  by  the  Deans  of  the
16        Colleges of Agriculture at Southern  Illinois  University
17        and the University of Illinois.
18             (7)  A  representative from the Illinois Division of
19        Tourism, ex officio, to be named by the Director  of  the
20        Illinois Department of Commerce and Community Affairs.
21             (8)  Six  persons  to  be  named  by the Director of
22        Agriculture from nominations from the  President  of  the
23        Illinois Grape Growers and Vintners Association such that
24        3 are grape growers and 3 are vintners.
25        (c)  Members    of   the   Council   shall   receive   no
26    compensation, but shall be reimbursed for necessary  expenses
27    incurred in the performance of their duties.
28        (d)  The Council's Chair shall be the Dean of the College
29    of Agriculture at Southern Illinois University at Carbondale.
30        (e)  The  Council  shall  be  housed at Southern Illinois
31    University   at   Carbondale,   which   shall   maintain    a
32    collaborative relationship with the University of Illinois at
33    Champaign.

 2        Sec. 12-2.  Powers and duties of Council.
 3        (a)  Upon  the  appointment  of  its  final  member,  the
 4    Council  shall  adopt bylaws governing its members, meetings,
 5    terms of office, and administration.
 6        (b)  The  Council  shall  provide  support   and   growth
 7    services to the grape wine industry in Illinois that include,
 8    but  need  not  be  limited  to:  (i)  advocacy, liaison, and
 9    promotion  of  grape  growing  and  wine  making,  (ii)   the
10    provision of consultation and special training to prospective
11    and   established   grape  growers  and  wine  makers,  (iii)
12    viticulture and enological research pertinent to  State  wine
13    industry  needs,  and  (iv) development of marketing policies
14    and strategies.
15        (c)  The Council shall  not  enter  into  any  effort  to
16    regulate the price of grape products or wine.

18        Sec.  12-3.  Tax. The Department of Revenue shall deposit
19    in the Grape and Wine Resources Fund  created  under  Section
20    12-1  of  this  Act $0.02 of the wine excise tax collected on
21    each gallon of wine under Section 8-1 of this Act.
22        Moneys collected under this Section  shall  be  deposited
23    into  the  Grape  Wine Resources Fund and administered by the
24    Illinois Department of Agriculture, which shall serve as  the
25    lead  administrative  agency  for  monitoring  the  Council's
26    implementation.  Moneys  in  the Fund shall be transferred to
27    the  Department   of   Agriculture   annually,   subject   to
28    appropriation,   and  the  Department  of  Agriculture  shall
29    allocate to the Council for use in achieving its  objectives.
30    These   moneys  shall  not  be  used  for  any  political  or
31    legislative purpose.  The Council shall keep minutes,  books,
32    and records that clearly reflect all acts and transactions of
33    the  Council.  The books of the Council shall be audited by a

 1    certified public accountant at the Council's expense at least
 2    annually.  Within 30 days after the completion of such audit,
 3    the results shall be provided to the Director of Agriculture.
 4    The Department of Agriculture shall  be  reimbursed  for  any
 5    costs  incurred  under  this  Article from the Grape and Wine
 6    Resources Fund. Moneys remaining in the Fund at  the  end  of
 7    the  fiscal  year shall remain in the Fund for use during the
 8    following year and shall not  be  transferred  to  any  other
 9    State fund.
