 1                    AMENDMENT TO HOUSE BILL 1678
 2        AMENDMENT NO.     .  Amend House Bill 1678  by  replacing
 3    the title with the following:
 4        "AN  ACT  in relation to the regulation of wine, amending
 5    named Acts."; and
 6    by replacing everything after the enacting  clause  with  the
 7    following:
 8        "Section  5.   The State Finance Act is amended by adding
 9    Section 5.449 as follows:
10        (30 ILCS 105/5.449 new)
11        Sec. 5.449.  The Grape and Wine Resources Fund.
12        Section 10.  The Liquor Control Act of 1934 is amended by
13    adding Section 1-3.37 and Article XII as follows:
14        (235 ILCS 5/1-3.37 new)
15        Sec.  1-3.37.  "Council"  means  the   Grape   and   Wine
16    Resources Council.

18           ARTICLE XII.  GRAPE AND WINE RESOURCES COUNCIL

 1        (235 ILCS 5/12-1 new)
 2        Sec. 12-1.  Grape and Wine Resources Council.
 3        (a)  There is hereby created the Grape and Wine Resources
 4    Council,  which shall have the powers and duties specified in
 5    this Article and all other powers  necessary  and  proper  to
 6    execute the provisions of this Article.
 7        (b)  The Council shall consist of 13 members including:
 8             (1)  The  Director  of  the  Illinois  Department of
 9        Agriculture, ex officio, or the Director's designee.
10             (2)  The Dean of the SIU College of Agriculture,  or
11        the Dean's designee.
12             (3)  The  Dean of the University of Illinois College
13        of Agriculture, or the Dean's designee.
14             (4)  An  expert  in  enology  or  food  science  and
15        nutrition to be named by the  Director  of  the  Illinois
16        Department  of  Agriculture  from  nominations  submitted
17        jointly  by  the  Deans of the Colleges of Agriculture at
18        Southern  Illinois  University  and  the  University   of
19        Illinois.
20             (5)  An  expert  in  marketing  to  be  named by the
21        Director of the Illinois Department of  Agriculture  from
22        nominations   submitted  jointly  by  the  Deans  of  the
23        Colleges of Agriculture at Southern  Illinois  University
24        and the University of Illinois.
25             (6)  An  expert  in  viticulture  to be named by the
26        Director of the Illinois Department of  Agriculture  from
27        nominations   submitted  jointly  by  the  Deans  of  the
28        Colleges of Agriculture at Southern  Illinois  University
29        and the University of Illinois.
30             (7)  A  representative from the Illinois Division of
31        Tourism, ex officio, to be named by the Director  of  the
32        Illinois Department of Commerce and Community Affairs.
33             (8)  Six  persons  to  be  named  by the Director of
34        Agriculture from nominations from the  President  of  the

 1        Illinois Grape Growers and Vintners Association such that
 2        3 are grape growers and 3 are vintners.
 3        (c)  Members    of   the   Council   shall   receive   no
 4    compensation, but shall be reimbursed for necessary  expenses
 5    incurred in the performance of their duties.
 6        (d)  The Council's Chair shall be the Dean of the College
 7    of Agriculture at Southern Illinois University at Carbondale.
 8        (e)  The  Council  shall  be  housed at Southern Illinois
 9    University   at   Carbondale,   which   shall   maintain    a
10    collaborative relationship with the University of Illinois at
11    Champaign.

13        Sec. 12-2.  Powers and duties of Council.
14        (a)  Upon  the  appointment  of  its  final  member,  the
15    Council  shall adopt by-laws governing its members, meetings,
16    terms of office, and administration.
17        (b)  The  Council  shall  provide  support   and   growth
18    services to the grape wine industry in Illinois that include,
19    but  need  not  be  limited  to:  (i)  advocacy, liaison, and
20    promotion  of  grape  growing  and  wine  making,  (ii)   the
21    provision of consultation and special training to prospective
22    and   established   grape  growers  and  wine  makers,  (iii)
23    viticulture and enological research pertinent to  State  wine
24    industry  needs,  and  (iv) development of marketing policies
25    and strategies.
26        (c)  The Council shall  not  enter  into  any  effort  to
27    regulate the price of grape products or wine.

29        Sec.  12-3.  Tax. The Department of Revenue shall deposit
30    in the Grape and Wine Resources Fund  created  under  Section
31    12-1  of  this  Act $0.02 of the wine excise tax collected on
32    each gallon of wine under Section 8-1 of this Act.

 1        Moneys collected under this Section  shall  be  deposited
 2    into  the  Grape  Wine Resources Fund and administered by the
 3    Illinois Department of Agriculture, which shall serve as  the
 4    lead  administrative  agency  for  monitoring  the  Council's
 5    implementation.  Moneys  in  the Fund shall be transferred to
 6    the  Department   of   Agriculture   annually,   subject   to
 7    appropriation,   and  the  Department  of  Agriculture  shall
 8    allocate to the Council for use in achieving its  objectives.
 9    These   moneys  shall  not  be  used  for  any  political  or
10    legislative purpose.  The Council shall keep minutes,  books,
11    and records that clearly reflect all acts and transactions of
12    the  Council.  The books of the Council shall be audited by a
13    certified public accountant at the Council's expense at least
14    annually.  Within 30 days after the completion of such audit,
15    the results shall be provided to the Director of Agriculture.
16    The Department of Agriculture shall  be  reimbursed  for  any
17    costs  incurred  under  this  Article from the Grape and Wine
18    Resources Fund. Moneys remaining in the Fund at  the  end  of
19    the  fiscal  year shall remain in the Fund for use during the
20    following year and shall not  be  transferred  to  any  other
21    State fund.".
