90_HB2065 725 ILCS 5/124A-5 Amends the Code of Criminal Procedure of 1963. Provides that the defendant if convicted shall pay the costs of prosecution of a university traffic ordinance. Provides that costs of prosecution include costs in serving criminal summons and criminal subpoenas. Provides that costs shall be in addition to all other costs, fees, and fines. LRB9005355RCmg LRB9005355RCmg 1 AN ACT to amend the Code of Criminal Procedure of 1963 by 2 changing Section 124A-5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Code of Criminal Procedure of 1963 is 6 amended by changing Section 124A-5 as follows: 7 (725 ILCS 5/124A-5) 8 Sec. 124A-5. Judgment for costs of prosecution. When a 9 person is convicted of an offense under a statute, university 10 traffic ordinance, or at common law, the court shall enter 11 judgment that the offender pay the costs of the prosecution. 12 The costs shall include reasonable costs incurred by the 13 Sheriff for serving arrest warrants, criminal subpoenas, and 14 criminal summons, for picking up the offender from a county 15 other than the one in which he or she was convicted, and for 16 picking up the offender from a location outside the State of 17 Illinois pursuant either to his or her extradition or to his 18 or her waiver of extradition. The costs shall be in 19 addition to all other costs, fees, and fines. 20 (Source: P.A. 89-234, eff. 1-1-96.) 21 Section 99. Effective date. This Act takes effect upon 22 becoming law.
