          Amends  the  Vehicle  Code  to  provide  that  a   person
      convicted of a second or subsequent violation for operating a
      vehicle   when  registration  is  suspended  for  not  having
      insurance is guilty of a Class B misdemeanor.  Provides  that
      a  person  driving  without  a  license or permit and without
      insurance shall have his or her vehicle impounded.

 1        AN ACT concerning vehicles, amending a named Act.
 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:
 4        Section  5.   The  Illinois  Vehicle  Code  is amended by
 5    changing Sections 3-708 and 6-101 as follows:
 6        (625 ILCS 5/3-708) (from Ch. 95 1/2, par. 3-708)
 7        Sec. 3-708.  Operation of motor vehicle when registration
 8    suspended  for  noninsurance.   No  person  shall  operate  a
 9    vehicle the registration of which is  suspended  pursuant  to
10    Section 7-606 or 7-607 of this Code.
11        Any  person convicted of violating this Section is guilty
12    of a business offense and shall be required to pay a fine  of
13    not  less  than  $1,000  and not more than $2,000. Any person
14    convicted of a second or subsequent violation of this Section
15    is guilty of a Class B misdemeanor and shall be  required  to
16    pay a fine of not less than $1,000 and not more than $2,000.

19        Sec.  6-101.   Drivers must have licenses or Permits. (a)
20    No person, except those expressly exempted by Section  6-102,
21    shall  drive  any  motor vehicle upon a highway in this State
22    unless such person has  a  valid  license  or  permit,  or  a
23    restricted  driving  permit,  issued  under the provisions of
24    this Act.
25        (b)  No person shall drive  a  motor  vehicle  unless  he
26    holds  a  valid  license  or  permit, or a restricted driving
27    permit issued under the provisions of Section  6-205,  6-206,
28    or  6-113 of this Act. Any person to whom a license is issued
29    under the provisions  of  this  Act  must  surrender  to  the
30    Secretary  of State all valid licenses or permits. No drivers

 1    license shall be issued to  any  person  who  holds  a  valid
 2    Foreign  State license unless such person first surrenders to
 3    the Secretary of State any such valid Foreign State license.
 4        (c)  Any person licensed as a driver hereunder shall  not
 5    be  required by any city, village, incorporated town or other
 6    municipal corporation to obtain any other license to exercise
 7    the privilege thereby granted.
 8        (d)  In addition to other penalties  imposed  under  this
 9    Section,  any person in violation of this Section who is also
10    in violation of  Section  7-601  of  this  Code  relating  to
11    mandatory  insurance requirements shall have his or her motor
12    vehicle  immediately   impounded   by   the   arresting   law
13    enforcement  officer.   The  motor vehicle may be released to
14    any licensed driver upon a showing of proof of insurance  for
15    the  motor  vehicle  that  was  impounded  and  the notarized
16    written consent for the release by the vehicle owner.
