90_HB2805enr 110 ILCS 947/35 Amends the Higher Education Student Assistance Act. Requires the Illinois Student Assistance Commission to present an annual report to the Governor, General Assembly, and Board of Higher Education recommending funds needed to broaden eligibility for the monetary award program. Effective July 1, 1998. LRB9009920THpk HB2805 Enrolled LRB9009920THpk 1 AN ACT relating to higher education, amending named Acts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Public Community College Act is amended 5 by changing Section 3-8 as follows: 6 (110 ILCS 805/3-8) (from Ch. 122, par. 103-8) 7 Sec. 3-8. Following each election and canvass, the new 8 board shall hold its organizational meeting on or before the 9 14th day after the election, except that in 1999, 2001, and 10 2003 the board shall organize within 14 days after the first 11 Tuesday after the first Monday of November in each of those 3 12 years. If the election is the initial election ordered by the 13 regional superintendent, the organizational meeting shall be 14 convened by the regional superintendent, who shall preside 15 over the meeting until the election for chairman, vice 16 chairman and secretary of board is completed. At all other 17 organizational meetings, the chairman of the board, or, in 18 his or her absence, the president of the community college or 19 acting chief executive officer of the college shall convene 20 the new board, and conduct the election for chairman, vice 21 chairman and secretary. The board shall then proceed with 22 its organization under the newly elected board officers, and 23 shall fix a time and place for its regular meetings. It 24 shall than enter upon the discharge of its duties. The terms 25 of board office shall be 2 years, except that the board by 26 resolution may establish a policy for the terms of office to 27 be one year, and provide for the election of officers for the 28 remaining one year period. Terms of members are subject to 29 Section 2A-54 of the Election Code. 30 Special meetings of the board may be called by the 31 chairman or by any 3 members of the board by giving notice HB2805 Enrolled -2- LRB9009920THpk 1 thereof in writing stating the time, place and purpose of the 2 meeting. Such notice may be served by mail 48 hours before 3 the meeting or by personal service 24 hours before the 4 meeting. 5 At each regular and special meeting which is open to the 6 public, members of the public and employees of the community 7 college district shall be afforded time, subject to 8 reasonable constraints, to comment to or ask questions of the 9 board. 10 (Source: P.A. 90-358, eff. 1-1-98.) 11 Section 10. The Chicago State University Law is amended 12 by changing Section 5-15 as follows: 13 (110 ILCS 660/5-15) 14 Sec. 5-15. Membership; terms; vacancies. The Board 15 shall consist of 7 voting members appointed by the Governor 16 by and with the advice and consent of the Senate, and, until 17 July 1, 2001, one voting member who is a student at Chicago 18 State University. The student member serving on the Board on 19 the effective date of this amendatory Act of 1997 shall be a 20 voting student member for the remainder of his or her term on 21 the Board. Beginning on July 1, 2001, and thereafter, the 22 student member of the Board shall be a nonvoting member. The 23 method of selecting the student member shall continue to be 24 determined by a campus-wide student referendum. The student 25 member shall serve a term of one year beginning on July 1 of 26 each year, except that the student member initially selected 27 shall serve a term beginning on the date of his or her 28 selection and expiring on the next succeeding June 30. To be 29 eligible for selection as a student member and to be eligible 30 to remain as a student member of the Board, the student 31 member must be a resident of this State, must have and 32 maintain a grade point average that is equivalent to at least HB2805 Enrolled -3- LRB9009920THpk 1 2.5 on a 4.0 scale, and must be a full time student enrolled 2 at all times during his or her term of office except for that 3 part of the term which follows the completion of the last 4 full regular semester of an academic year and precedes the 5 first full regular semester of the succeeding academic year 6 at the university (sometimes commonly referred to as the 7 summer session or summer school). If a student member 8 serving on the Board fails to continue to meet or maintain 9 the residency, minimum grade point average, or enrollment 10 requirement established by this Section, his or her 11 membership on the Board shall be deemed to have terminated by 12 operation of law. Of the members first appointed by the 13 Governor, 4 shall be appointed for terms to expire on the 14 third Monday in January, 1999, and 3 shall be appointed for 15 terms to expire on the third Monday in January, 2001. If the 16 Senate is not in session on the effective date of this 17 Article, or if a vacancy in an appointive membership occurs 18 at a time when the Senate is not in session, the Governor 19 shall make temporary appointments until the next meeting of 20 the Senate when he shall nominate persons to fill such 21 memberships for the remainder of their respective terms. No 22 more than 4 of the members appointed by the Governor shall be 23 affiliated with the same political party. Upon the expiration 24 of the terms of members appointed by the Governor, their 25 respective successors shall be appointed for terms of 6 years 26 from the third Monday in January of each odd-numbered year 27and until their respective successors are appointed for like28terms. The student member serving on the Board 7 on the effective date of this amendatory Act of 1997 shall be 8 a voting student member for the remainder of his or her term 9 on the Board. Beginning on July 1, 2001, and thereafter, the 10 student member of the Board shall be a nonvoting member. The 11 method of selecting the student member shall continue to be 12 determined by a campus-wide student referendum. The student 13 member shall serve a term of one year beginning on July 1 of 14 each year, except that the student member initially selected 15 shall serve a term beginning on the date of his or her 16 selection and expiring on the next succeeding June 30. No 8 more than 4 of the members appointed by the Governor shall be 9 affiliated with the same political party. Upon the expiration 10 of the terms of members appointed by the Governor, their 11 respective successors shall be appointed for terms of 6 years 12 from the third Monday in January of each odd-numbered year 13and until their respective successors are appointed for like14terms. If a student member serving on the 15 Board fails to continue to meet or maintain the residency, 16 minimum grade point average, or enrollment requirement 17 established by this Section, his or her membership on the 18 Board shall be deemed to have terminated by operation of law. 19 Of the members first appointed by the Governor, 4 shall be 20 appointed for terms to expire on the third Monday in January, 21 1999, and 3 shall be appointed for terms to expire on the 22 third Monday in January, 2001. If the Senate is not in 23 session on the effective date of this Article, or if a 24 vacancy in an appointive membership occurs at a time when the 25 Senate is not in session, the Governor shall make temporary 26 appointments until the next meeting of the Senate when he 27 shall nominate persons to fill such memberships for the 28 remainder of their respective terms. No more than 4 of the 29 members appointed by the Governor shall be affiliated with 30 the same political party. Upon the expiration of the terms of 31 members appointed by the Governor, their respective 32 successors shall be appointed for terms of 6 years from the 33 third Monday in January of each odd-numbered yearand until34their respective successors are appointed for like terms. The student member serving HB2805 Enrolled -9- LRB9009920THpk 1 on the Board on the effective date of this amendatory Act of 2 1997 shall be a voting student member for the remainder of 3 his or her term on the Board. Beginning on July 1, 2001, and 4 thereafter, the student member of the Board shall be a 5 nonvoting member. The method of selecting the student member 6 shall continue to be determined by a campus-wide student 7 referendum. The student member shall serve a term of one 8 year beginning on July 1 of each year, except that the 9 student member initially selected shall serve a term 10 beginning on the date of his or her selection and expiring on 11 the next succeeding June 30. To be eligible to remain as a 12 student member of the Board, the student member must be a 13 resident of this State, must have and maintain a grade point 14 average that is equivalent to at least 2.5 on a 4.0 scale, 15 and must be a full time student enrolled at all times during 16 his or her term of office except for that part of the term 17 which follows the completion of the last full regular 18 semester of an academic year and precedes the first full 19 regular semester of the succeeding academic year at the 20 university (sometimes commonly referred to as the summer 21 session or summer school). Effective date. This Act takes effect upon 18 becoming law.
